🚩 HR Red Flag: When the Story Doesn’t Match the Facts

Here’s a scenario we see more often than you might think.

A company reached out seeking leadership and HR advisory support. During our discovery process, we asked one of our standard onboarding questions:

“Are there any current employee relations concerns, compensation disputes, or issues we should know about?”

The answer was simple: “No.”

Yet as the conversation unfolded, the facts told a different story.

Multiple locations. Frontline manager concerns. Questions surrounding incentive pay. Growing frustration among leadership. Then suddenly, several managers resigned at the same time and sought legal counsel.

One issue stood out immediately: 💰 Commissions and incentive pay.

If an organization has historically paid commissions, bonuses, or incentive compensation based on established practices and performance metrics, employers should think carefully before changing or eliminating those payments. Compensation structures aren’t something leaders should casually alter without understanding the legal, financial, and employee relations implications.

But here’s the bigger lesson.

You can hire the best attorney, accountant, or HR advisor available. None of us can provide sound guidance if we’re not given accurate and detailed information.

When leaders withhold facts, minimize concerns, or tell half the story, they’re not protecting themselves. They’re preventing their advisors from identifying risks before they become expensive problems.

✅ For employers: Transparency isn’t a weakness. It’s the foundation of good advice.

✅ For employees: Pay attention when leadership’s words and actions don’t align. Trust is built through consistency, communication, and follow-through.

✅ Small business reality check:

Many of us invest heavily into our local communities.
We join chambers.
Sponsor events.
Volunteer our time.
Provide free resources.
Support nonprofits.
Refer business.
Show up consistently.
Speak at events.
Promote local growth.

And sometimes… the support doesn’t come back around.

That can be a hard reality for small business owners to process, especially when you genuinely care about building authentic community relationships.

✨ The truth is:
Many small businesses are carrying the weight of visibility, education, networking, and collaboration without large marketing budgets or corporate backing. We’re building relationships one conversation, one referral, and one opportunity at a time.

🚨 Business Owners: Your Independent Contractors Should NOT Be Using Your Employee Handbook

One of the most common compliance mistakes we see is businesses providing 1099 independent contractors with employee handbooks filled with attendance policies, PTO rules, schedules, discipline procedures, and manager oversight.

🚩While it may seem harmless, this can unintentionally create “employee-level control,” a major red flag for agencies like the Internal Revenue Service, U.S. Department of Labor, and the Michigan Department of Labor and Economic Opportunity when determining worker classification.

In Michigan, the safer and more compliant approach is to maintain separate documentation structures for W-2 employees and 1099 contractors.

Independent contractors should operate under a properly drafted Independent Contractor Agreement outlining scope of work, deliverables, confidentiality, and payment terms, not employee policies.

🚩 One misclassification issue can quickly turn into back taxes, wage claims, penalties, audits, and unnecessary legal exposure. The documentation matters more than many businesses realize.
