The Irony of Compromise in Conflict Resolution is found in that the more open to compromise one is, the less likely they are to HAVE to compromise.

When parties enter a negotiation or mediation process with a spirit of openness and a willingness to compromise, it often cultivates a similar attitude in others. This mutual mindset fosters a collaborative atmosphere where each party feels heard, respected, and valued. It does this by:

Creating a Collaborative Environment: Being open to compromise signals a readiness to engage constructively, encouraging all parties to find common ground. It helps in de-escalating tensions, making it easier to navigate the complexities of the dispute.

Promoting Understanding and Empathy:: When one is open to compromise, it often leads to a deeper understanding of each other’s perspectives, needs, and interests. This willingness to understand and validate each other’s viewpoints reduces defensiveness and resistance, making compromise seem less like a concession and more like a shared solution.

Have you ever found yourself tangled in a disagreement that feels like it’s going nowhere? Imagine if there was a friendly way to sort things out without it costing a fortune, and without having to go to court. Well, guess what? There is! It's called mediation, and it’s like having a helpful guide to find a path through the maze of conflict. Mediation is pretty amazing because it’s all about making things easier and better for everyone involved.

First off, mediation is a real money-saver. Going to court can be really expensive, but mediation is way more affordable. In mediation, everyone shares the cost, making it much lighter on our pockets. Plus, it’s super private and confidential, allowing everyone to speak freely and honestly. There aren’t any records or notes taken, so what’s said in mediation, stays in mediation. This helps build trust and opens the door to finding solutions that work for everyone.

Mediation is also really convenient and flexible. It doesn’t have to happen in a cold, formal courtroom. It could be somewhere comfortable or even online if that’s easier. This means that mediation can fit around our lives and schedules, not the other way around! And here's the best part - in mediation, you have the control. It’s not about winners or losers; it’s about working together to create solutions that everyone is happy with. It’s a space where everyone’s voice is heard, and the outcome is in the hands of the people involved, not a judge or arbitrator.

As a mediator, I'm here to help guide everyone through resolving workplace conflicts in a way that feels safe and respectful. When we meet, one key thing we use is a confidentiality agreement, a special promise that ensures what we talk about stays only between us. This agreement is not just a personal promise but is also backed by the rules set in the Uniform Mediation Act. This Act helps make sure that our discussions are kept private and secure, allowing everyone to speak openly and honestly.

Having confidentiality as a part of our process is like building a bridge of trust, even when trust seems a little shaky at the start. Knowing that our conversations are protected helps everyone feel more comfortable sharing their feelings and thoughts. It’s an essential step in working through disagreements and finding solutions that make our workplace better and happier.

Imagine you're in a thick forest, and you find two groups of people on separate paths, trying to find their way out. They are lost, frustrated, and can’t agree on which direction to go. This is where I step in, like a friendly guide, to help them find a common path out of the woods. As a mediator, I act as a "neutral advocate." Think of me as a champion, fighting for both sides, helping everyone to find a solution that works well. I stand in the middle, making sure that each person’s voice is heard and valued. I help untangle the confusion and emotion, guiding people from the tough, scary parts of conflict to a clearer and calmer place where things start making sense.

Arbitration and litigation may resolve disputes but mediation is required to resolve the conflict.

Arbitration and litigation are structured processes that focus on determining liability and assigning judgement based on legal parameters. They are pivotal tools for dispute resolution where a third party, judge or arbitrator, makes a binding decision based on facts, laws, and presented arguments.

However, mediation takes a more holistic approach, aiming not just to settle the dispute but also to address underlying conflicts, fostering understanding and facilitating communication between the parties involved. Mediation is more about rebuilding and restoring relationships, cultivating empathy, and facilitating mutual understanding, which leads to more sustainable and satisfying resolutions, for all parties involved. At the discretion of the parties, those agreements can be binding, or non-binding, temporary or permanent.

In mediation, the focus is on creating a resolution that is co-created by the parties, which can lead to innovative solutions that a court or arbitrator might not have the flexibility to impose. So while arbitration and litigation may conclude disputes legally, mediation nurtures the ground for lasting peace and understanding, resolving not just the surface dispute but also mitigating the underlying conflicts.

It is easier to resist at the beginning than at the end.

A study done at the racetrack back in the late 1960’s uncovered a fascinating trait about people: Just after placing a bet on their horse, they grew more confident about that horse’s chances of winning than they were immediately prior to placing the bet. Sort of an odd shift when considering the variables are the same horse, same bet and same field of competition. What changed?

Well, nothing has changed. What the researchers uncovered was our nearly obsessive desire to be, and appear, consistent with what we’ve already done. Once we make a choice or take a stand, we will encounter both personal (internal) and interpersonal (external) pressures to behave consistently with the path we’ve committed to. Pressures to change our position or stance will likely be met with resistance as we tend to respond in ways that justify our earlier position. We simply convince ourselves that we’ve made the right choice and, no doubt, feel better about our decision. The zeal and veracity of support for the current political candidates is strong testament to this.

This penchant for consistency to our commitments has little to do with our common value of honoring our commitments but a great deal to do with ensuring our safety. When we thoughtfully commit to perform a task or complete an assignment we are setting the stage for our success. When, however, we thoughtlessly or mindlessly, commit to a path without regard for reasonably foreseeable outcomes or emergences, we effectively close the door on being able to respond to conditions as they exist and as they emerge, setting the stage for disaster.

Lesson: As a species, we’re “hard-wired” to act consistently with our beliefs and decisions. While that may seem like a reasonable expectation, having mindless rigidity to a poorly thought out plan or path can severely limit your ability to recognize or effectively respond to conditions contrary to your assumptions. Staying mindful of your surroundings and variability of hazards is the only way to create and maintain your safety.

I've been going through my old notes and documents recently and thought I'd take a swing at developing a " " describing what has been successfully applied, individually and collectively, for optimum performance results within high-hazard environments. With respect to Dr. Deming, this model is no exception.

Key points, whatever information was available was considered incomplete, there was also a collective recognition and acceptance of the inherent to the , prepared and equipped accordingly. The shared the sense of expedited , empowered action while also enhancing individual , increasing the likelihood of success.

Tried to keep things action oriented in terms of what facilitated and contributed to operational success and a return to the of everyday . I recognize the complexity, but I'll take a team with , and EVERY day of the week.

The "practice of safety" always reminds me of Chapter 1 of the Tao te Ching where the " , or all that is this experience of , that can be described is not the eternal Tao. The name that can be spoken is not the eternal Name." Without "safe" there is no real life and the road to safe begins with what we do to survive...especially when living in a world.
