💼 HR Scenario Spotlight: The Salesman Dilemma 💼

Imagine this: David is a top-performing salesman. He consistently crushes his numbers and brings in new business…but he also tends to bend the rules. Maybe he skips out on required reporting, talks over colleagues in meetings, or ignores company policies because, in his mind, “results matter more than process.”

So here’s the HR question:
👉 Do you turn a blind eye because he’s bringing in top revenue?
👉 Or do you hold him accountable to the same standards as everyone else, even if it risks losing a high performer?

This is where culture meets compliance. Your policies, values, and consistency in enforcement all send a message to your team.

🚨 Quick HR Tip: Allowing one employee to play by different rules, even a rockstar salesperson, creates resentment, lowers morale, and could expose your business to risk. Long-term, accountability builds stronger teams than short-term numbers ever will.

How would you handle the salesman dilemma? Drop your thoughts below ⬇️

Employee vs. Contractor: Why Getting It Wrong Can Cost You

One of the most common compliance pitfalls employers face is worker misclassification, treating someone who should be an employee as an independent contractor. It may seem like a shortcut to save on payroll taxes and benefits, but the risks far outweigh the short-term savings.

🔹 Employees
• Work under your direction and control
• Typically have set schedules which are set by the employer
• Use your equipment and tools
• Receive wages, benefits, and protections (overtime, workers’ comp, unemployment, etc.)

🔹 Contractors
• Operate independently and control how they do the work
• Set their own hours and use their own tools
• Invoice for services rather than earn wages
• Generally cover their own taxes and benefits

❌ The Penalties for Misclassification
• Back payment of wages and overtime
• Reimbursement of benefits owed
• Employer’s share of payroll taxes, plus penalties and interest
• Possible fines from the IRS, Department of Labor, and state agencies
• In severe cases: lawsuits, reputational harm, and even personal liability for business owners

✅ The Takeaway
Before labeling someone a “contractor,” call us! We can help you wade through federal and state guidelines. Remember, the true cost of getting it wrong is far greater than paying an employee correctly from the start.

Let’s play a game! We’ll call it “What would my HR consultant do?”

The Dilemma:
You discover that a long-tenured, well-liked employee has been falsifying time records to cover for a single mother on their team who was consistently late due to childcare struggles. Leadership has no clue, and the “helping” employee did this out of compassion, not personal gain.

⚖️ Your choices:
• Fire the long-tenured employee for dishonesty (risking massive morale fallout).
• Fire or discipline the struggling single mom (risking PR backlash and morale issues).
• Sweep it under the rug (risking precedent, liability, and your own credibility if it comes out).
• Try a creative alternative… if you can think of one.

Give us a call if you’ve come across situations such as this where this is no perfect answer. We pride ourselves in promoting consistent accountability, compassion and culture in everything we do!

Health Insurance renewal season is here!
And rates are going up (again)… but before you just accept the changes, ask yourself:

👉 Is my broker really working for me?

A great broker should bring you options, explain them clearly, and help control costs without sacrificing employee care. And don’t forget the importance of customer service!

If you haven’t compared brokers in a while, now’s the time. Think of it as giving your broker their own “performance review.”

Because the right broker doesn’t just manage insurance, they help protect your team and your budget.

We’ve worked with a number of local insurance brokers and can help make sure that your broker is meeting all of your needs. Give us a call!

🚨 Top 3 HR Mistakes Comanies Make 🚨
(And how to avoid a paperwork disaster…)

📌 1. “Winging it” on onboarding
Skipping a formal process or checklist might seem efficient, until it’s not.

📌 2. No documentation = no defense
If it’s not written down, it didn’t happen. Verbal agreements won’t help you in court.

📌 3. Confusing “independent contractor” with “employee”
It’s not just a job title, it’s a legal classification. And yes, the IRS does care.

Starting off right saves money, time, and a whole lot of stress.
📞 Call us before these “small mistakes” turn into big headaches.

Promoting from within is great for morale, but too often, we forget one crucial step:

👉 Giving new managers the tools, training, and support they need to succeed.

Leadership isn’t automatic just because someone was great at their job.
Without proper preparation, you risk setting them, and your team, up for confusion, conflict, and burnout.

Whether it’s coaching, communication skills, compliance know-how, or just a clear roadmap…
New managers need more than a new title.
