The seemingly million dollar question that I get ask allot from some of my entrepreneur clients : Is it better to elect to be taxed as an LLC or an S-Corp?

Unpopular answer: It depends on your business! Consult your CPA, tax attorney or other professional for advice specific to your situation.

My general Tips is ☝🏾

If you own an LLC and want to be taxed as an S-Corp you need to make the election with the IRS using Form 2553. Choosing to be taxed as an S-Corp will require more paperwork than an LLC. Your tax professional should be very knowledgable in handling matters like this; make sure that they are well informed as well.

Truth is, single member LLCs and S-Corps both get pass thru taxation by default and S-Corps require more paperwork come tax season. So why choose an S-Corp?

Reduce self-employment tax while keeping pass thru taxation. As the owner of an S-Corp you are not considered self-employed. Rather, you’re an employee of the corporation. You can pay yourself a salary and still take some of the business profit in the form of dividends.

Neither will be subject to the self-employment tax and neither is subject to double taxation (which is the issue you run into with C-Corps).
