I had to correct some of my own understanding on this one.
So I went digging.
Because right now we have 𝐭𝐰𝐨 𝐯𝐞𝐫𝐲 𝐝𝐢𝐟𝐟𝐞𝐫𝐞𝐧𝐭 𝐦𝐨𝐧𝐞𝐲 𝐬𝐭𝐨𝐫𝐢𝐞𝐬 floating around, and folks are mixing them together like somebody put politics, health insurance, tariffs, and the U.S. Constitution in the same blender. 😂
Let’s separate them.
🟢 𝐅𝐈𝐑𝐒𝐓: 𝐓𝐇𝐄 $𝟓𝟎𝟎 𝐀𝐂𝐀 𝐑𝐄𝐅𝐔𝐍𝐃
President Trump announced that about 𝟏 𝐦𝐢𝐥𝐥𝐢𝐨𝐧 𝐩𝐞𝐨𝐩𝐥𝐞 𝐞𝐧𝐫𝐨𝐥𝐥𝐞𝐝 𝐢𝐧 𝐜𝐞𝐫𝐭𝐚𝐢𝐧 𝐀𝐟𝐟𝐨𝐫𝐝𝐚𝐛𝐥𝐞 𝐂𝐚𝐫𝐞 𝐀𝐜𝐭 𝐩𝐥𝐚𝐧𝐬 𝐰𝐢𝐥𝐥 𝐫𝐞𝐜𝐞𝐢𝐯𝐞 $𝟓𝟎𝟎 𝐫𝐞𝐟𝐮𝐧𝐝𝐬.
✅ 𝐓𝐡𝐢𝐬 $𝟓𝟎𝟎 𝐫𝐞𝐟𝐮𝐧𝐝 𝐢𝐬 𝐫𝐞𝐚𝐥 𝐚𝐧𝐝 𝐡𝐚𝐬 𝐛𝐞𝐞𝐧 𝐚𝐧𝐧𝐨𝐮𝐧𝐜𝐞𝐝.
But…
❌ 𝐓𝐡𝐢𝐬 𝐢𝐬 𝐍𝐎𝐓 𝐭𝐡𝐞 𝐧𝐨𝐫𝐦𝐚𝐥 𝐎𝐛𝐚𝐦𝐚𝐜𝐚𝐫𝐞 𝐫𝐞𝐛𝐚𝐭𝐞 𝐈 𝐨𝐫𝐢𝐠𝐢𝐧𝐚𝐥𝐥𝐲 𝐭𝐡𝐨𝐮𝐠𝐡𝐭 𝐢𝐭 𝐰𝐚𝐬.
The ACA already has something called the Medical Loss Ratio rule.
Basically, insurance companies must spend a certain percentage of premium dollars on actual health care and improving care.
If they don’t?
💵 They may owe customers money back.
That has been part of the Affordable Care Act for years. A president doesn’t suddenly create that rebate.
But Trump’s new $500 refund is different.
This money involves fees insurers paid to operate on the federal ACA marketplace, HealthCare.gov. Those fees get built into insurance premiums.
The government collected more money than was needed to operate the marketplace.
The Trump administration is now returning some of that excess money to certain people who paid full or nearly full premiums.
So:
✅ Trump’s administration 𝐜𝐚𝐧 𝐚𝐝𝐦𝐢𝐧𝐢𝐬𝐭𝐞𝐫 𝐦𝐨𝐧𝐞𝐲 𝐰𝐡𝐞𝐧 𝐞𝐱𝐢𝐬𝐭𝐢𝐧𝐠 𝐥𝐚𝐰 𝐠𝐢𝐯𝐞𝐬 𝐭𝐡𝐞 𝐞𝐱𝐞𝐜𝐮𝐭𝐢𝐯𝐞 𝐛𝐫𝐚𝐧𝐜𝐡 𝐚𝐮𝐭𝐡𝐨𝐫𝐢𝐭𝐲 𝐭𝐨 𝐝𝐨 𝐬𝐨.
✅ The $500 refund involves an 𝐞𝐱𝐢𝐬𝐭𝐢𝐧𝐠 𝐀𝐂𝐀 𝐟𝐮𝐧𝐝𝐢𝐧𝐠 𝐦𝐞𝐜𝐡𝐚𝐧𝐢𝐬𝐦.
❌ Trump did 𝐧𝐨𝐭 𝐜𝐫𝐞𝐚𝐭𝐞 𝐭𝐡𝐞 𝐀𝐟𝐟𝐨𝐫𝐝𝐚𝐛𝐥𝐞 𝐂𝐚𝐫𝐞 𝐀𝐜𝐭 𝐦𝐞𝐜𝐡𝐚𝐧𝐢𝐬𝐦 𝐭𝐡𝐚𝐭 𝐠𝐞𝐧𝐞𝐫𝐚𝐭𝐞𝐝 𝐭𝐡𝐞𝐬𝐞 𝐟𝐮𝐧𝐝𝐬.
❌ This is 𝐧𝐨𝐭 𝐭𝐡𝐞 𝐨𝐫𝐝𝐢𝐧𝐚𝐫𝐲 𝐀𝐂𝐀 𝐌𝐞𝐝𝐢𝐜𝐚𝐥 𝐋𝐨𝐬𝐬 𝐑𝐚𝐭𝐢𝐨 𝐫𝐞𝐛𝐚𝐭𝐞.
❌ And not everybody with Obamacare gets $500.
That last one is important.
Now…
Put that $500 over here. 👉🏾
Because the $𝟓,𝟎𝟎𝟎 𝐩𝐫𝐨𝐦𝐢𝐬𝐞 𝐢𝐬 𝐚 𝐜𝐨𝐦𝐩𝐥𝐞𝐭𝐞𝐥𝐲 𝐝𝐢𝐟𝐟𝐞𝐫𝐞𝐧𝐭 𝐚𝐧𝐢𝐦𝐚𝐥.

At the Republican midterm convention, President Trump promised $𝟓,𝟎𝟎𝟎 𝐭𝐨 𝐀𝐦𝐞𝐫𝐢𝐜𝐚𝐧 𝐚𝐝𝐮𝐥𝐭𝐬 𝐢𝐟 𝐑𝐞𝐩𝐮𝐛𝐥𝐢𝐜𝐚𝐧𝐬 𝐫𝐞𝐭𝐚𝐢𝐧 𝐜𝐨𝐧𝐭𝐫𝐨𝐥 𝐨𝐟 𝐂𝐨𝐧𝐠𝐫𝐞𝐬𝐬.
That sounds wonderful.
Shoot, five grand?
I can think of some bills that would suddenly experience the healing power of immediate deliverance. 😂
But we have this little document called…
📜 𝐓𝐇𝐄 𝐔𝐍𝐈𝐓𝐄𝐃 𝐒𝐓𝐀𝐓𝐄𝐒 𝐂𝐎𝐍𝐒𝐓𝐈𝐓𝐔𝐓𝐈𝐎𝐍.
And it refuses to leave the group chat.
Article I, Section 9, Clause 7 says federal money cannot be taken from the Treasury unless it has been 𝐚𝐩𝐩𝐫𝐨𝐩𝐫𝐢𝐚𝐭𝐞𝐝 𝐛𝐲 𝐥𝐚𝐰.
Translation:
❌ 𝐓𝐡𝐞 𝐩𝐫𝐞𝐬𝐢𝐝𝐞𝐧𝐭 𝐜𝐚𝐧𝐧𝐨𝐭 𝐬𝐢𝐦𝐩𝐥𝐲 𝐝𝐞𝐜𝐢𝐝𝐞 𝐭𝐨 𝐬𝐞𝐧𝐝 𝐞𝐯𝐞𝐫𝐲 𝐚𝐝𝐮𝐥𝐭 $𝟓,𝟎𝟎𝟎.

❌ Calling the money a "𝐝𝐢𝐯𝐢𝐝𝐞𝐧𝐝" does not magically change who controls federal spending.
❌ Saying tariff revenue will pay for it does not automatically give the president authority to distribute that money however he wants.
So what 𝐂𝐀𝐍 happen?
✅ Trump can 𝐩𝐫𝐨𝐩𝐨𝐬𝐞 $5,000 payments.
✅ He can ask voters to support the idea.
✅ He can ask 𝐂𝐨𝐧𝐠𝐫𝐞𝐬𝐬 to pass legislation creating the payments.
✅ Congress can determine who qualifies.
✅ Congress can establish the funding and legal authority.
✅ If Congress passes that legislation, Trump can sign it into law.
𝐓𝐇𝐄𝐍 𝐰𝐞 𝐡𝐚𝐯𝐞 𝐨𝐮𝐫𝐬𝐞𝐥𝐯𝐞𝐬 𝐚 𝐩𝐫𝐨𝐠𝐫𝐚𝐦.
Until then?
We have a 𝐩𝐫𝐨𝐩𝐨𝐬𝐚𝐥.
Not a check.
Not an entitlement.
Not an appropriation.
Not $5,000 sitting at Treasury with your name written on it.
And certainly not something the president can personally guarantee will happen just because one political party wins an election.

🏛️ 𝐀𝐍𝐃 𝐓𝐇𝐈𝐒 𝐈𝐒 𝐖𝐇𝐘 𝐂𝐎𝐍𝐆𝐑𝐄𝐒𝐒 𝐌𝐀𝐓𝐓𝐄𝐑𝐒
Sometimes we talk about presidents as though we elect a temporary king every four years.
We don't.
Congress has enormous constitutional authority over federal money.
Congress taxes.
Congress creates spending laws.
Congress appropriates money.
The president executes the laws Congress passes.
There are exceptions where existing laws already give executive agencies discretion over appropriated funds. That helps explain why the $𝟓𝟎𝟎 𝐀𝐂𝐀 𝐫𝐞𝐟𝐮𝐧𝐝 and the proposed $𝟓,𝟎𝟎𝟎 𝐩𝐚𝐲𝐦𝐞𝐧𝐭 are legally different questions.
One involves money and authority that already exist within an established federal program.
The other would create an enormous new federal payment.
Those are not the same thing.

Politicians love putting several facts close together because our brains naturally connect them.
$𝟓𝟎𝟎 𝐫𝐞𝐟𝐮𝐧𝐝.
$𝟓,𝟎𝟎𝟎 𝐝𝐢𝐯𝐢𝐝𝐞𝐧𝐝.
𝐓𝐚𝐫𝐢𝐟𝐟 𝐫𝐞𝐯𝐞𝐧𝐮𝐞.
𝐄𝐥𝐞𝐜𝐭𝐢𝐨𝐧.
Put them close enough together and suddenly they can feel like one story.
They aren't.
The question isn't: "𝐃𝐨 𝐈 𝐥𝐢𝐤𝐞 𝐓𝐫𝐮𝐦𝐩?"
The question isn't: "𝐃𝐨 𝐈 𝐝𝐢𝐬𝐥𝐢𝐤𝐞 𝐓𝐫𝐮𝐦𝐩?"
Those questions tell us almost nothing about whether the claim is true.
Ask better questions:

That works no matter who occupies the White House.
Because political literacy means knowing the difference between:

and
"𝐈 𝐡𝐚𝐯𝐞 𝐭𝐡𝐞 𝐥𝐞𝐠𝐚𝐥 𝐚𝐮𝐭𝐡𝐨𝐫𝐢𝐭𝐲 𝐭𝐨 𝐝𝐨 𝐭𝐡𝐢𝐬."
Those are two VERY different sentences.
And somewhere between those sentences…
