California’s SB 343: The October 2026 Deadline Food Brands Can’t Ignore

California is tightening the rules around recyclability claims.

Beginning October 4, 2026, products and packaging manufactured after that date must meet strict criteria before displaying the recycling symbol or making unqualified recyclability claims under SB 343, the state’s “Truth in Recycling” law.

This isn’t just a labeling tweak.

Under SB 343, a material must be:
• Collected by recycling programs serving at least 60% of Californians
• Sorted into defined recycling streams serving the same threshold
• Routinely used as feedstock to make new products

In other words, packaging must be recyclable in practice, not just in theory.

Importantly, the law applies based on manufacture date, not sale date. Products made before October 4, 2026 are not subject to the new labeling restrictions, even if sold later. But new production runs after that date must comply.

For food manufacturers, this shifts packaging decisions from marketing-driven to compliance-driven. Beyond enforcement risk, there’s growing scrutiny around greenwashing. Consumers, regulators, and state agencies are paying closer attention to environmental claims.

SB 343 also signals a broader trend. Extended Producer Responsibility (EPR) laws are already active in states like Oregon and Colorado, and more are coming. Packaging strategy now intersects directly with liability exposure, fees, and long-term brand trust.

The companies reviewing their packaging portfolios today will be in a much stronger position tomorrow.
