The Wisdom of Estate Planning
A Must Read

The Petersons were counting on selling their properties to enjoy a comfortable retirement and leave something nice for their children. Instead, heavy taxes destroyed most of their plans.

The Smiths had similar properties, but because they planned properly, they secured a good retirement income for themselves, blessed their children, and supported their favorite charity.

Then there’s Rose Jones. After her husband suddenly passed away, she was left confused and overwhelmed. He always said “everything is taken care of,” but he died without a will. Assets were frozen, government papers kept coming, and some of their property automatically went to his children from a previous marriage — even though that wasn’t what he wanted. She had to hire lawyers just to sort out the mess.

But Mary Brown’s story was different. When her husband died, she and their children were financially secure because he had planned ahead. Life insurance was in place, she knew exactly what belonged to her, and everything transferred smoothly. She was still grieving, but she didn’t have to worry about money.

What made the difference?

Estate Planning.

Estate planning is simply deciding who gets what when you die, and arranging it in the smartest, most peaceful way possible. It includes making a will, setting up trusts, naming beneficiaries, and organizing your assets.

Yet, over 70% of adults in the U.S still don’t have a will (there are no official statistics on this about Samoa, but perhaps it could safely be concluded that many people do not have wills. The reason for this may be because there are many cases in Samoa regarding estates of people who died "intestate". Dying intestate simply means a person died without a legally valid will. Dying with a legally valid will is legally called dying testate).

Common excuses:

“I’m too busy.”

“I don’t have much.”

“I don’t like thinking about death.”

But the truth is: If you care about your loved ones, estate planning is one of the most loving things you can do.

Simple Steps to Get Started:

• List everything you own and what you owe (your net worth)

• Decide your goals: Who do you want to protect? (spouse, children, parents, charity?)

• Choose the right people (executor, guardian, trustee)

• Get professional help from a lawyer who understands estate planning

Don’t make the mistake of just adding names to titles thinking it solves everything — it can actually create bigger problems.

Estate planning isn’t just for the rich. It’s for anyone who wants to protect their family and reduce stress when they’re gone.

GP Consults Hosts Second AML Hotspot for Samoa Law Society, 23 March 2026

GP Consults was invited by the Samoa Law Society to present its second Hotspot seminar on Anti-Money Laundering, Terrorist Financing, and Proliferation of Weapons of Mass Destruction (collectively referred to as AML Standard). The seminar was designed for all lawyers practising in Samoa. Although this was GP Consults’ second presentation at the Law Society, it was the first Hotspot for 2026.
The event was held on 23 March 2026 at the CBS Conference Room. GP Consults had the honour of co-presenting with two senior officials from the Financial Intelligence Unit of the Central Bank of Samoa:

• Afioga Lemauga Sioa Atina’e Sioa, Head of the Financial Intelligence Unit;

• Afioga Faumuina Dominic Talouli, Assistant Head of the Financial Intelligence Unit.

Recent changes have been made to Samoa’s AML Laws, particularly those affecting lawyers and their legal obligations.

GP Consults is well placed to help lawyers apply these standards in the Samoan context. Samoa has a different economy and resource base compared to Australia and New Zealand. While AML standards in those countries are designed for high-volume economies with greater cash flow and activity, Samoa is a developing nation with limited resources and technology. Our AML framework must therefore be practical, adaptable and appropriate for our local situation. This is also taking i tk account that compliance costs money.

This is not an attempt to lower the implementation of AML standards. Rather, it simply reflects the principle captured in the Samoan saying:

“E le mafai ona tatou agaia se matagi, ae e mafai ona fetuutuuna’i la o le tatou va’a.”
(Translation: We cannot sail our ship against the wind, but we can adjust its sails accordingly.)

In other words, we do not overlook AML requirements; we implement them in a way that is realistic and workable for Samoa.

🔔Important Update: Adoptions in Samoa & New Zealand Law🔔

The Samoa District Court has issued an important update regarding adoption applications involving New Zealand citizens or residents. Below is the key information you need to know.

New Zealand has temporarily changed its adoption laws (effective 18 September 2025), meaning most overseas adoptions by New Zealand citizens or residents — including those in Samoa — are no longer automatically recognised for NZ citizenship or visas.

What this means:
A Samoan adoption may still be granted and is legally binding in Samoa.
However, the child may not be able to live with you in New Zealand.
The Samoa District Court has made it clear that adoption orders cannot be undone / discharged later just because NZ immigration or citizenship is refused.
Adoptive parents remain permanently responsible, regardless of NZ outcomes.

These NZ law changes are expected to remain in place until at least 1 July 2027, and the outcome of government discussions is still uncertain.

More than 80% of Samoan land is customary land. The other percentage of land is called government land. Which means roughly 12% of land is freehold land. Freehold land is the only land we can purchase and own – no strings attached!

The population of Samoa is growing exponentially, which is now more than 200,000 people. Add the number of our fellow Samoans residing in New Zealand, Australia, the United States and other parts of the world, and the number of Samoans could be well more than a million. Now compare that to the 12% freehold land left in Samoa. And not all of it is for sale, which leaves a very minimal percentage of land left for sale.

This ¼ acre at Vailima could be yours for only SAT$199,000. This could also be your retirement plan, or this could also be the start of a new family home. There is a Samoan expression which says “e lele le Toloa, ae ma’au lava i le vai”. No matter where we are in this world, one day, we will long to come back home, Samoa.

Pregame Jitters - Many people feel anxious before delivering a big presentation or competing in an important event. They experience quicker breathing, a faster heart rate, a heightened arousal. If we interpret these feelings positively, then we can respond with fluidity and grace. You can reframe “I am nervous” to “I am excited and I’m getting an adrenaline rush to help me concentrate”. These little mind-set shifts aren’t magic, but they can help change the feelings you associate with a particular habit or situation (source: from a Book).

As a side observation, It's interesting to note that the mind does not distinguish between positive or negative thoughts, it automatically processes what we put into it. If we fill it with negative thoughts, the brain will process it. Similarly, if we fill it with positive thoughts, the brain will also process positivity, thereby creating positive circumstances. How are we utilizing our minds? So before we deliver a public speech and feel nervous, remember, we can say something positive like "I am calm, I am collected, and I will deliver this speech with ease and fluidity".

What is the difference between a legal person and a natural person?

A natural person is a human being – someone who can breathe, own property under his or her name, and sue or be sued. A legal person, on the other hand, is not a human being, but is recognised by law as having similar rights. A legal person can also own property, sue others and be sued.

An example of a legal person is a company, let’s call it Supermarket X. Supermarket X Company Limited is a business that sells goods to its customers such as fruits, vegetables, as well as locally produced meat. Supermarket X is not a natural person, it is a legal person. It can own land that the business sits on, and if the company needs to sue someone (or other companies), it can do so under the name Supermarket X. But who signs all the paper work for Supermarket X? Good question! What do you think?

In simple terms, companies are owned by shareholders. These shareholders typically appoint directors to run the company. The directors oversee how the company operates and sign the important documents, such as land ownership papers, on its behalf.

There are also different types of companies, such as private companies and public companies, but that is a story for another time. For now, these are the basics of the difference between a natural person and a legal person, and how a company works.
