Shipman partners Melissa Sydney and Andrew Davis were delighted to attend the CBIZ, Inc. Women's Forum in Boston last week—an inspiring event filled with insightful speakers, meaningful conversations and a strong sense of community. One of the (many) highlights was the opportunity for our colleague, Andrew, to spend time with Erin Brockovich talking about environmental law and her environmental passions, new (PFAS and data centers) and old (hex chrome, the subject of the Hinkley, CA movie). And in a memorable moment, Erin suggested that if Julia Roberts reprises her role in a future sequel, Brad Pitt might be the right choice to play Andrew, the environmental attorney. We can't confirm any casting decisions, but we certainly enjoyed the suggestion.

Thank you to CBIZ for hosting such a fantastic event and bringing together so many accomplished professionals.

📢 CCSBA MEMBER ALERT: Major Federal H**p & Cannabis Law Changes Just Went Into Effect

Dear CCSBA Members,
We want to ensure every Connecticut cannabis small business owner stays fully informed about the major federal h**p-related law changes that were passed this month. These changes will have real and immediate impacts on h**p-derived products, licensing compliance, product testing, and market competition here in Connecticut.

Here’s what you need to know:

---

🔹 1. Federal Definition of H**p Has Changed

Congress passed legislation revising the federal definition of “h**p.”
Effective immediately, h**p must contain no more than 0.3% total THC — including THCA — on a dry weight basis.

This is a dramatic shift from the previous focus on delta-9 THC only.
It effectively closes the loophole that allowed intoxicating h**p-derived products such as THCA flower, delta-8 THC, delta-10 THC, and other synthesized cannabinoids to be sold outside of regulated cannabis markets.

---

🔹 2. Intoxicating H**p Products Are Now Federally Restricted

The new appropriations bill (“minibus spending package”) included a nationwide provision targeting intoxicating h**p products, such as:

THCA flower

Delta-8 and delta-10 products

H**p-derived edibles and beverages marketed for intoxication

V**e and concentrate products made from converted C*D

Many of these will no longer be considered “h**p” and may now fall under federal controlled-substance classification depending on their cannabinoid profile.

This is expected to drastically reshape the national h**p market and create a more level playing field with state-regulated cannabis businesses.

---

🔹 3. States — Including Connecticut — Are Expected to Adjust Enforcement

Connecticut already has stricter controls than many states, but federal action will likely accelerate:

Enforcement against out-of-state h**p intoxicants crossing into CT

Crackdowns on non-licensed retailers selling high-THC “h**p” items

More pressure on labs to properly account for total THC, not just delta-9

Clarification of what products can be legally sold in C*D/h**p shops

This may strengthen the regulated cannabis marketplace — but it also creates new compliance obligations for Connecticut operators.

---

🔹 4. What Didn’t Change

To clarify:
This is NOT federal cannabis legalization, decriminalization, or full rescheduling.
This law is specifically targeted at the h**p loophole and intoxicating cannabinoids.

---

🔹 5. What This Means for CCSBA Members

We encourage all small businesses to:

Review your product portfolio for compliance

Speak with legal counsel or compliance consultants ASAP

Prepare for shifting competition in the Connecticut market

Monitor supply chain changes for h**p-derived cannabinoids

Anticipate updates from the DCP (Department of Consumer Protection)

Our goal is to keep every Connecticut cannabis operator informed and supported through these rapid federal changes.

---

📄 We Created a Full Presentation Explaining All These Changes

To help our members understand the updates in detail, we prepared a full slide presentation breaking down:

The exact language of the new law

What products are affected

Expected enforcement priorities

Market impact for Connecticut

Action steps for small businesses
