Fines Instead of Court Cases ⚠️💸

Non-compliance is no longer handled in court first. Instead, the government can now impose immediate and substantial fines.

Employers take note:

Failing to report an accident within 7 days may result in the employer paying 100% of the employee’s compensation.

Failing to pay an injured employee’s salary (temporary disablement) for the first 3 months can trigger a penalty equal to the full compensation amount plus interest

Compliance delays can now become very expensive — very fast.

Extended Time for Claims ⏳
Workers now have up to 3 years to file an injury claim — previously just 12 months. This means employers must keep accident records for longer, as injuries can resurface or worsen years after the incident.

Good record-keeping isn’t optional — it’s protection.

Employer Responsibility for Transport Accidents.

If an employer provides or arranges transport for employees (like a shuttle service), the employer is liable from pickup to drop-off. Even if the driver is at fault, the responsibility still rests with the employer.

Knowing your obligations can save you serious legal trouble later.

Liability for Subcontractors

When you hire a subcontractor, their workers can legally be treated as your employees — unless the subcontractor has paid all required insurance premiums. If they haven’t, you could end up footing the bill.

👉 Always verify compliance before bringing a subcontractor on board.

You can't automatically reject applicants or dismiss employees over criminal records—it's unfair discrimination unless the offence directly relates to the job's inherent requirements (e.g., theft for cash-handling roles). Per LRA/EEA, assess relevance, context & rehabilitation fairly; blanket bans violate law.

For a legally valid employment contract, ensure consensus, contractual capacity, legality, possibility of performance, and clear terms. BCEA mandates written particulars (e.g., wages, hours, leave) for most employees—verbal agreements bind but risk disputes. Avoid vague clauses or pitfalls like unjustified fixed-term contracts!

Cautionary tale from SA Labour Court (Singisi Forest Products v CCMA): A shop steward was fairly dismissed for fabricating a grievance accusing his manager of assault—full of inconsistencies and no corroboration. Court ruled employers don't have to tolerate dishonest false accusations that could ruin colleagues' careers, as they shatter trust. Honesty is non-negotiable!
