When are you entitled to severance pay?

An employee who has been employed continuously for one year by the same employer and has been dismissed is entitled to severance pay. Severance pay is offered to employees who have been dismissed for operational requirements, for example, economic, technological, structural or similar needs of an employer. The severance package will depend on how long the employee was employed for.

Do you have an issue with unpaid salary?
In terms of the BCEA, an employer must pay remuneration not later than seven days after (a) the completion of the period for which the remuneration is payable or (b) the termination of the contract of employment. If you are alleging unpaid salary or outstanding money and you earn below the BCEA threshold of R224 080.48 per annum, you may refer the matter to the CCMA for further assistance.

Rights of employees in the workplace

On a regular basis, I receive e-mails from employees asking the question “What are my rights ?”. Employees have certain general rights. These may not necessarily be entrenched in labour law, but come from basic human rights issues, the Constitution, common law and in some case, from legislation.

Every employee has the right :

Not to be unfairly dismissed
To be treated with dignity and respect
To be paid the agreed wage on the agreed date and at the agreed time
To be provided with appropriate resources and equipment to enable him/her to do the job
To have safe working conditions
To fair labour practices
To non-victimisation in claiming rights and using procedures
To all the protection and benefits of the Basic Conditions of Employment Act.
