Got old rules on your title deed blocking your development plans?📜🏠

That “only one house allowed” or “no business use” condition from 1960 can stop your rezoning, subdivision, consent, permission or building plans dead.

Removal of Restrictive Conditions application.
The legal way to delete those old rules.

In plain English:
1. Why: Old title deeds often say you can’t run a business, subdivide, or build closer than 7m from the street. If your plans conflict, council will refuse you.
2. What it does: Asks Gauteng Province + Tshwane to legally erase that condition so you can use your land like everyone else.
3. When you need it: Rezoning to Business 1, subdividing your erf, building a second dwelling, opening a creche/shop from home.
4. How long: +/- 6-12 months. Runs at the same time as your rezoning/ consent/ permission so you don’t lose time.

Bottom line: If the Deeds Office says “no” but the Town Planning Scheme says “yes”, you probably need a Removal of Restrictions.

Solar power solutions - these systems need to register with Eskom or Municipality:

"Small-scale embedded generation facilities with an installed capacity of 100kW or less and with a point of connection to the electricity grid are required to register with the relevant distributor, being Eskom or the applicable licenced municipality;
and
Embedded generation facilities with an installed capacity of more than 100 kW and apoint of connection to the grid are required to register directly with Nersa."

Nersa has clarified the registration requirements for residential solar and small-scale embedded generation installations, following concerns raised by Outa about unclear regulations.
