You no longer have access to your SARS eFiling profile.

Does this mean your tax residency status cannot be corrected or backdated? This is not the case. While eFiling is the primary platform used, SARS can still be engaged through formal processes or with the assistance of a registered practitioner. Your status can be regularised, provided the correct steps and supporting documentation are submitted.

Many individuals delay addressing their tax position because of administrative barriers. That delay can be costly.

If you assumed you are stuck, it may be worth reconsidering your options. Contact us: https://bit.ly/3OW14r8

Not every country has a Double Taxation Agreement (DTA) with South Africa.

For mining professionals working across certain African or remote jurisdictions, this raises a critical question: are you exposed to double taxation with no relief?

The answer is not always straightforward. Even in the absence of a DTA, there may be alternative applications to mitigate or eliminate double taxation, depending on your tax residency status and how your income is structured.

If you thought you were tax efficient, there may still be areas of exposure you may not have considered. Contact us for assistance: https://bit.ly/4g0rV0l

For rotational workers, Double Taxation Agreement (DTA) relief is rarely straightforward.

In this matter, we provided end-to-end assistance by preparing and submitting a formal request to SARS for a Notice of Non-Resident Tax Status, supported by a detailed legal opinion. This required a precise and structured approach to ensure the factual and legal position was clearly substantiated.

SARS subsequently confirmed a backdated cessation date from 2024.

DTA outcomes are not determined by where income is earned alone, but instead require a holistic assessment of residency status, applicable treaty provisions, time spent in each jurisdiction, and the structure of the employment arrangement in order to establish the correct tax position.
