💼 CHILD MAINTENANCE: Where do I start?

One of the most stressful parts of separation or divorce is maintenance — especially when there is conflict or no support at all. Many parents feel overwhelmed and unsure of their rights. Here’s a simple guide to help you take the first step:

🔹 WHAT IS MAINTENANCE?
In terms of South African law, *both parents* have a legal duty to support their child financially — this includes food, clothing, education, medical care, and daily living expenses.

🔹 WHERE DO I START?
You can begin by opening a maintenance case at your nearest Maintenance Court (usually at your local Magistrate’s Court).

Take the following with you:
✔ Your ID
✔ Child’s birth certificate
✔ Proof of expenses (school fees, groceries, medical, rent, etc.)
✔ Any proof of the other parent’s income (if available)

If you don’t have all the documents — don’t panic. The court can assist in obtaining information.

🔹 WHAT IF THE OTHER PARENT REFUSES TO PAY?
You have the right to apply for maintenance. The court will investigate both parents’ financial positions and make an order based on what is fair and in the *best interests of the child*.

🚫 IMPORTANT TO KNOW:
• You do NOT need to be married to claim maintenance
• You do NOT need a lawyer to start the process
• Maintenance is the child’s right — not the parent’s

Unless there are serious safety concerns, children benefit from having meaningful relationships with both parents. Support contact and communication.

🔹 DO keep communication respectful
Even if emotions are high, try to communicate calmly and constructively. Children are deeply affected by ongoing conflict.

🔹 DO create a clear parenting plan
A structured parenting plan helps avoid confusion and conflict. It can be made an order of court and provides stability for your child.
