An apology, is not enough" says the court.
She was corned by a male colleague in a secluded area, and was harassed. He will sent her WhatsApp messages in the middle of the night. She ended up in hospital, and he just apologized. The Labour Court had one response: an apology does not undo what you did to her.

Mr Louw did not dispute the conduct at Arbitration. Instead he argued two things: 1. his apology resolved the matter, 2. that proceeding with dismissal after the apology amounted to double jeopardy. The Arbitrator upheld the dismissal. louw took it to review with the Labour Court.

Sexual Harassment is among the most serious forms of workplace misconduct striking at the heart of a person dignity, integrity, and self worth.

The review process was dismissed. The dismissal stand without an order. The court went as far, yo criticise the Department of Correctional Service, that it failed to protect the complainant and fail to expeditiously finalize the matter.

There is so much to learn from this incident. Sadly, it is not the first time in the past year that employees have died at their workplaces due to high stress and feeling unwell, after being denied the opportunity to seek medical assistance.

Employers must do better. This reflects poorly on leadership and organisational culture, and shows how far many of us still are from practicing transformational leadership – from executive level through to line management.

From my legal and HR experience, I share this insight in the hope that it helps organisations and leaders across the board to reflect and improve.

Celebrating Lytania Johnson - proud Eldorado Park/Klipspruit woman. May this journey, bring success upon success.

We’re proud to announce that Lytania Johnson will be stepping in as CEO of FNB, after 25 years of growing with the business, and with our customers.

Having spent much of her career in personal banking, her perspective is grounded in the everyday realities of South Africans. How people live, earn and manage their money. And that matters as we move into this next chapter. This moment marks more than a leadership change, it’s a step towards a simpler, more connected FNB - Where retail and business banking come together to better reflect real life.

As Harry Kellan prepares to retire in 2026, we thank him for his leadership in shaping a stronger, more agile FNB.
