There is so much to learn from this incident. Sadly, it is not the first time in the past year that employees have died at their workplaces due to high stress and feeling unwell, after being denied the opportunity to seek medical assistance.

Employers must do better. This reflects poorly on leadership and organisational culture, and shows how far many of us still are from practicing transformational leadership – from executive level through to line management.

From my legal and HR experience, I share this insight in the hope that it helps organisations and leaders across the board to reflect and improve.

Woolworths (Pty) Ltd v CCMA and Other (2026)

Employee dismissed for "suspicious behaviour" on CCTV, but mo theft or rule of breach was proven.

Charges must match allegations. Trust relationship must be broken. The dismissal was substantively Unfair.

Employee was reinstated, with 6months back pay.

Take away for Employers:
1. Ensure Clear Evidence.
2. Follow correct disciplinary action.
3. Prove breakdown of trust relationship.
