FORMER DEPUTY NATIONAL COMMISSIONER OF SAPS DENIED BAIL IN R**E AND SEXUAL GROOMING CASE

The National Prosecuting Authority (NPA) welcomes the Randburg Magistrates’ Court’s decision to deny bail to former Deputy National Commissioner of the South African Police Service (SAPS), Shadrack Mongo Sibiya (59), who faces charges relating to allegations of r**e, trafficking in persons and the sexual grooming of a child.

Sibiya faces five charges, including r**e, trafficking in persons, promoting the sexual grooming of a child and two counts of sexual grooming of a child.

The State alleges that the accused sexually groomed the child through electronic communication between 20 July 2026 and 03 August 2026. He also faces a r**e charge relating to an alleged incident involving the adult female complainant on 16 May 2026. The trafficking in persons charge stems from allegations involving three individuals.

During the bail proceedings, the State argued that the interests of justice did not permit the accused’s release on bail. It further submitted that the complainants were in a state of fear and that there was a likelihood that they could be threatened or intimidated if the accused were released.

The State also argued that no bail conditions could adequately address the risks involved, including the possibility of the accused interfering with witnesses or tampering with evidence.

In denying bail, the court considered the vulnerability of the complainants and the potential risk of interference with evidence. The court further held that the accused had failed to discharge the onus of satisfying it that the interests of justice permitted his release on bail.

The matter has been postponed to 24 November 2026 for further investigations.

The NPA remains committed to ensuring that cases involving allegations of sexual offences, trafficking in persons and the exploitation of children are prosecuted diligently. The decision to deny bail underscores the importance of safeguarding vulnerable complainants and protecting the integrity of the criminal justice process.

KATLEHONG SHOOTING: MAN ACCUSED OF KILLING FOUR APPEARS IN COURT

The case against 46-year-old Fani John Sibeko, who is accused of killing four people and injuring three others during a shooting incident in Katlehong North, appeared before the Palmridge Magistrates’ Court.

Sibeko faces four counts of murder and three counts of attempted murder, as well as charges of discharging a fi***rm in a public place and failure to safeguard a fi***rm.

The charges relate to an incident that allegedly occurred on 13 October 2026, when a group of African National Congress (ANC) supporters was returning from a memorial service for the late Councillor Jeanese Magugu at Mogobeng Primary School.

It is alleged that while the group was walking and chanting, gunshots were heard from behind them. A man driving a motor vehicle allegedly approached the group and initially fired shots into the air before firing multiple shots into the crowd.

Four people were killed and three others injured. The deceased have been identified as Nqobile Faneli (23), Njabulo Ngcongo (23), Zanga Bingwa (21) and Yonwaba Tunce (27).
Following the incident, Sibeko allegedly handed himself over to the police and remains in custody. The case docket has been assigned to the Gauteng Political Killings Task Team (PKTT) for further investigation.

The State requested a seven-day postponement to allow for further bail investigations. The matter was accordingly postponed to 22 October 2026.

The NPA remains committed to ensuring that serious violent crimes are prosecuted effectively and that those alleged to be responsible are held accountable through the criminal justice process.
