What is "mediation"? Loosely defined, it is a process whereby a third party (the mediator) facilitates a settlement between two or more parties in dispute. It would be characterised as an ADR process but is substantially different from Arbitration and Adjudication, in that the mediator does not determine the outcome. Current success rates for commercial mediation globally stand at around 85%.
