HEALTH & SAFETY IS NON-NEGOTIABLE: The Cost of Complacency

A recent ruling by the Labour Court has reaffirmed a vital principle for every industry: Failure to enforce safety standards is grounds for immediate dismissal.

In a sector where shortcuts cost lives, the court upheld the dismissal of a mine manager who failed to properly implement and enforce critical health and safety protocols. The ruling sends a clear message to leadership across all high-risk environments: Accountability starts at the top.

Just over a week ago, B&H Safety Consultants had the privilege of contributing to two major Occupational Health & Safety platforms with eThekwini Municipality during the 11th World Day for Safety and Health Seminar and the Safety Practitioners Meeting.

On 22 April 2026, at the 11th World Day for Safety and Health Seminar held at Moses Mabhida Stadium, I had the honour of presenting on “Leadership, Culture & Psychosocial Safety: Unlocking High-
Performing & Resilient
Organisations”focusing on how leadership drives safety culture, accountability, decision-making, and the importance of management ownership in creating safe, engaging and resilient organisations.

On 23 April 2026, I further presented to the Municipality’s Technical Safety Experts and Safety Practitioners during the Occupational Health and Safety Unit’s Safety Practitioners Meeting, where I delivered a session on Behaviour Based Safety—addressing human behaviour, workplace habits, proactive interventions, and how organisations can move from reactive safety management to a culture of personal responsibility and prevention.

Both sessions reinforced a critical truth: safety is not just compliance—it is leadership, culture, and behaviour. That’s what drives high performance!

WHEN ROUTINE TURNS FATAL: The High Price of Poor Emergency Response Planning

We’ve all heard it: "It’s just a routine job." But in high-risk environments, there is no such thing as "routine."

In 2022, five divers entered a pipeline off Trinidad & Tobago for a standard repair. What followed was a nightmare: a pressure differential (Delta-P) event sucked all five men into a 30-inch pipe, dragging them 700 feet into total darkness & oil.

Miraculously, they survived the initial pull. They huddled together, shared air, & banged on the pipe for hours, waiting for the rescue they assumed was coming.
IT NEVER CAME.

While one diver managed to escape on his own, the company in charge refused to authorize a rescue for the others, claiming it was "too dangerous." They even used armed guards to block volunteer divers from attempting a rescue. Four men died because the people in charge prioritized liability & rigid control over human life.

THE POWER OF A TESTED PRE-INCIDENT PLAN (RESCUE PLAN):
Years ago, as a Fire Chief for a high-risk facility, I mandated a non-negotiable rule: No confined space entry without a validated risk rescue plan and a physical simulation.
We didn't just write it down; we ran the drills. Just days after one of these simulations, a roof collapsed during work on a large atmospheric tank, & a worker fell into a tank, sustaining soke serious injuries. Because we had literally just practiced that exact scenario, the rescue was seamless. That worker went home to his family.

WHY RESCUE SIMULATION IS NON-NEGOTIABLE:
A rescue plan on paper is just a theory. A simulation is a reality check. Here is why we must push for live drills:
• Identify Equipment Gaps: You don't want to find out your tripod is inadequate, your rescue line is too short or your winch is too slow or cannot handle the weight demands, when someone is bleeding out.
• Combatting "Rescue Paralysis": In the Trinidad disaster, management seemed to have frozen. Simulation builds the "muscle memory" needed to act decisively when every second counts.
• Validation of Timelines: Can your team actually reach the victim before their air runs out? If you haven't timed it, you don't know.
• Psychological Readiness: Simulations prepare the crew for the real life conditions such as possible claustrophobia and stress of a real event, reducing the chance of secondary accidents.

A MESSAGE TO LEADERSHIP:
Safety is not a cost center; it is a moral obligation. If a task is "too dangerous" to rescue someone from, then the task is too dangerous to perform in the first place.
Failure to plan for the worst is a choice to let the worst happen & in the worst possible way. Let’s commit to moving beyond "paper safety" and start proving our rescue capabilities through rigorous, honest simulations.
Because at the end of the day, "routine" shouldn't cost a life.

The Cost of Silence: What is Still Hidden?

In May 1996, the world witnessed the largest raptor die-off in recorded history. Over 1,500 Cape Vultures fell from the sky across Botswana, South Africa, Namibia, and Zimbabwe. For years, the cause was dismissed as "unexplained natural mortality."

The truth? A common livestock painkiller called Diclofenac. Harmless to mammals, but catastrophic for birds, causing total renal failure within hours.
Even though the data existed, it was buried for 18 years to protect market interests, while populations crashed by 92%.

Why This Matters Today:
• The Shadow Still Looms: Despite a 2014 ban, illegal use continues to threaten these critically endangered species.

• A Call for Transparency: If one drug could nearly wipe out a species in secret, what other environmental disasters are currently being covered up?

• Connecting the Dots: We cannot afford to ignore the signs. Conservation requires honesty, and progress requires accountability.

We believe that true leadership means looking at the hard truths—even when they are uncomfortable. Let’s stop letting critical warnings fade into silence.

The Hidden Cost of "Clean": Hand Sanitiser and Your Microbiome

While we often use hand sanitiser to protect our health, our latest Safety Talk highlights the long-term risks that often go unnoticed. It’s not just about killing germs; it’s about what we lose in the process.

The Impact on Immunity:
As discussed in the video, overusing alcohol-based sanitisers can strip away the skin's microbiome—the community of "good" bacteria that acts as your first line of defense. When this microbiome is destroyed, your natural immunity is compromised, making you more vulnerable to the very pathogens you're trying to avoid.

SAFETY & SNAKES: Imagine finding this under your bed!

A massive shoutout to Gerrie Heyns for handling a scary situation in Bonnievale and turning it into a vital lesson for all of us.
Gerrie was called out to retrieve a Cape Cobra (Naja nivea)—Africa's most venomous cobra—that was hiding under someone's bed. He actually found it with a large rat in its mouth!

How did this happen?
Before we panic or blame the snake, we have to look at the surroundings. Gerrie pointed out a few critical errors that invited this guest inside:
1. Dog food & water were left all over the yard.
2. Rodents love dog food.
3. Snakes love rodents.
4. Open doors gave the snake a free pass into the bedroom.

The Lesson:
If you live near the mountains or bush, you must minimize the attractants. If you feed the rats, you are inviting the snakes. It is that simple.
Let’s respect our wildlife by keeping our homes safe and not creating environments that bring them into conflict with us.

Night work - An employer may only require or permit an employee to perform night work, if so agreed, and if-
* the employee is compensated by the payment of an allowance, which may be a shift allowance, or by a reduction of working hours; and
* transportation is available between the employee’s place of residence and the workplace at the commencement and conclusion of the employee’s shift.
(3) An employer who requires an employee to perform work on a regular basis after 23:00 and before 06:00 the next day must-
(a) inform the employee in writing, or orally if the employee is not able to understand a written communication, in a language that the employee understands-
(i) of any health and safety hazards associated with the work that the employee is required to perform; and
(ii) of the employee’s right to undergo a medical examination in terms of
paragraph (b);
(b) at the request of the employee, enable the employee to undergo a medical examination, for the account of the employer, concerning those hazards-
(1) before the employee starts, or within a reasonable period of the employee
(ii)starting, such work; and
at appropriate intervals while the employee continues to perform such 20 work; and
(c) transfer the employee to suitable day work within a reasonable time if-
(i) the employee suffers from a health condition associated with the performance of night work; and
(ii) it is practicable for the employer to do so.

1. For the purposes of subsection (3), an employee works on a regular basis if the employee works for a period of longer than one hour after 23:00 and before 06:00 at least five times per month or 50 times per year.
2. The Minister may, after consulting the Commission, make regulations relating to the conduct of medical examinations for employees who perform night work.
