The benefits of Mediation

A qualified and accredited mediator should have undergone extensive training, examinations, an audit, have no criminal record and be suitably qualified in various aspects of psychology, law and in the case of Family law the developmental needs of children. The mediator is unbiased and acts as an impartial third party to the disputing parties. A mediator assists both parties to reach agreement that is going to work in both of their best interests. What makes the process so effective is that parties can contribute to creating their own working agreement, unlike Litigation where often there is a winner and a loser. Often emotions and anger take control of our rational thinking and we make decisions that we later regret, this can also have financial implications and negatively impact on any children involved as well as create stress for all parties involved. Mediation is a peaceful process and a mediator will guide parties through the process to create working agreements that are legally binding. Parties are also not under any obligation to reach an agreement and can terminate a mediation at any stage.

Conflict is at the heart of many problems that we see in the world today. Conflict is in our every day lives, at home, at work and just about everywhere else we go. Conflict is not inherently negative and can show us where we need to change, at the root of conflict we often find different perceptions about the same set of facts, often referred to as "Theory of mind". Imagine for a minute that 10 people are all looking at the same picture, we all tell a different story about the same picture based on our unique life experiences, culture and early childhood development. We do not all have to agree and so we realize that each of us have our own perception of the world that is very real to us. We can now respect that just as we have our own views so do others.
