New Year, New Intentions - Ditch the Resolutions!

As we enter a new year, many of us feel the urge to set resolutions - grand plans for self-improvement that often fall by the wayside. Instead, I encourage you to set intentions - desires and goals that align with your deepest values and sense of purpose.

When is an employer obliged to deduct PAYE tax from an independent contractor, and when is an independent contractor deemed to be an employee?

1. If the independent contractor (so name by his/her contract) falls within the definition of an employee in terms of labour legislation, then PAYE must be deducted, regardless of the wording of the contract, and certain employment benefits accrue to him/her, or

2. Even if the independent contractor does not fall within the definition of an employee, yet his/her payment falls within the definition of "remuneration" in terms of employment legislation, then PAYE must be deducted.

Who is responsible for determining whether an independent contractor's payment must be subject to PAYE deductions? The person/company making the payment must make the determination (accounting persons or auditors should be astute at undertaking these assessments).

What is the consequence of not making PAYE deductions when they should be (according to SARS)? The company paying the employee/independent contractor will be liable for paying outstanding PAYE, including penalties. Note that these payments can be claimed back from the employee/independent contractor, however such right should be included into the contract between the company and the independent contractor in order to create contractual rights on which to act where this becomes necessary.

What is the consequence of an independent contractor falling within the definition of employee? The independent contractor can claim rights that an employee is entitled to, in terms of employment legislation, including rights relating to the termination of his/her contract/employment, as well as several benefits that employees are entitled to, including leave, etc.

There are specific tests that are applied in assessing whether an independent contractor falls within the definition of employee, and whether payments made to him/her are "deemed" as "remuneration".

Employers should ensure that are compliant, in order to avoid the consequence of non-compliance.

COVID-19 : How to manage this in the workplace in SA?

“Sick leave” - employees need know that they must notify employers if they are presenting with symptoms of flu. They must notify the employer telephonically or via message & not come to work sick (if they start to feel sick after working hours). Employees who are off work because they are sick must produce a medical certificate in order to be entitled to sick leave and sick pay, even if they have been told to stay at home due to showing signs of illness. Employers have an obligation to provide a safe working environment & are therefore entitled to ask sick employees to not come to work.

“Alternatives to retrenchment & temporary measures” - employers who’s operations are significantly impacted due to COVID-19 can reduce staff hours and pay, or temporarily place staff on short-time/time off. This would be an alternative to retrenchment. There is a specific consultative process that must be followed & recorded, so advice should be sought before implementing these measures.

“Unemployment Benefits” - employees who contribute to UIF will be able to claim benefits where their hours & wages are reduced due to short-time.

Open communication with employees is key, as is acting in a fair & ethical manner.
