Over the past few months I have come across the misunderstanding of employers when it comes to the transfer of a business in terms of section 197 of the Labour Relations Act. Simplisticaly when a business transfers to another owner the new owner has to accept all the employees from the transferred business under the same terms and conditions of employment as the previous business. A condition of transfer is not for the new owner to inform the employees from the previous business that these are their new conditions of employment and expect them to sign a new contract of employment failing which they don't have a job in the business to which they are transferred. Conditions of employment however can be changed through consultation once the employee has started work under the new owner.

When does an employee have to retire?

There is no legislated retirement age in South Africa.

It is therefore important that an employer and employee ensure the retirement age is stipulated in the employment contract and the retirement fund should there be one.

Should an employer require an employee to work behind the retirement date then it is important that the employee retires and a separate short term contract of employment is agreed upon.

Failure to do the above and the employee continues working and their services are terminated an unfair dismissal case could be brought against the employer.

A matter that is likely to affect all employers and employees has been set down for the Constitutional Court regarding the discrepancies/discrimination to do with paternity leave and various other parental leave requirements currently in the Basic Conditions of Employment Act. Included in the application is for a couple to be able to determine the use of maternity leave between themselves and it not to be used only by the mother.

If an employee is facing the likelihood of retrenchment it is important to take a voluntary or forced retrenchment under advice before signing any document offered by the employer. In addition if the employer finds an affected person (retrenchee) alternative employment which is not unreasonable then the affected employee is not entitled to any retrenchment benefits/pay.

In terms of amendments to the Compensation for Occupational Injuries and Disease Act (COIDA) domestic workers are now covered in the event of an injury at their workplace. It is important one registers the domestic worker. This also includes casual workers.
