With the interim legal challenges to the Employment Equity Sectoral Targets having been dismissed, the Department of Employment and Labour is now legally positioned to enforce the new framework while the substantive constitutional matters continue through the courts.

📅 The Employment Equity submission window opens on 1 September 2026.

For Designated Employers (50 or more employees), this means the time to prepare is now—not when submissions open.

Businesses should already be reviewing:

✔️ Employment Equity Plans
✔️ Workforce profiles and demographic analysis
✔️ Recruitment and succession planning
✔️ Consultation processes
✔️ Annual reporting readiness

Failure to comply may expose organisations to significant penalties, including fines of up to R1.5 million or 2% of annual turnover, depending on the circumstances provided for in the Employment Equity Act.

We work with organisations to help ensure their Employment Equity strategies are practical, compliant, and aligned with legislative requirements.
