General Work Visa For South Africa

Over the years, the General work visa has become one of the most interesting types of visas in South Africa. The intention of regulations pertaining to this visa type has been to safeguard the interests of SA citizens in terms of the employment market. Foreign nationals conducting work activities in an environment that is otherwise saturated by unemployed SA citizens is something that is discouraged.

There are instances, however, where an individual may have a unique skill set and exposure that will prove to be essential and to the benefit of an organisation, without prejudicing the local labour market. In such instances, an individual can pursue a general work visa.

This is not an easy visa to secure. There are basically two routes to obtain the first requirement before securing a general work visa.

- Securing a Department of Labour Reccommendation Letter
- Securing a Department of Labour Recommendation Letterndation Letter

Both options, have become extremely challenging to secure as the Department of Labour process is understandably extremely intricate and detailed, whilst the waiver process has over the past 2 years become extremely lengthy, and challenging in it's own way.

Applying For Critical Skills Visa Under The Revised Skills List

Many individuals have been affected by the changes to the Critical Skills List. We are often approached by individuals whose designations are no longer considered Critical to South Africa, and they are at a loss as to how to proceed. If you are affected similarly, below is a break down of what the law requires:

- In order to apply for a new visa, or a visa renewal, you must comply with a designation noted on the 2022 Critical Skills list. This means you need to secure a re-assessment of your skill set through an accredited SA professional body;
- For first time applicants, you need a job offer in order to secure the visa. There are no exceptions to this requirement;
- Applicants for permanent residence who hold skills under the old list must obtain mandatory professional body registration with a designation aligned to the new list before they can apply for their visas.

For many applicants, who may consider this frustrating and redundant, it is important to remember that the downside is having no status at all. Please do your best to comply and plan submissions well in advance.

CHANGES IN IMMIGRATION LANDSCAPE HINDERING FOREIGNER CAPACITY TO REMAIN LEGAL IN SOUTH AFRICA

2022 has been a year of drastic changes as the Department of Home Affairs has implemented several changes to safeguard the labour market for SA citizens, and also to deter fraud and other illegal acts amongst foreigners seeking documentation. The impact of these well intended changes, have however resulted in lengthier processing times, and a more complex immigration landscape which is difficult to navigate.

It is increasingly more difficult for individuals wishing to regularise their stay to pursue the correct channels. We urge all our clients to ensure that they follow the steps below to maintain their compliance:

- Visa renewals - please start planning visa renewals well in advance to ensure that you are in a position to file an application 6 months from the visa expiry. Conduct due research on current legislation and how this impacts your visa options
- If applying for a first visa - review the VFS/ DHA Mission checklists to ensure that you meet all requirements. Try and ensure that you also plan your submission well in advance of your intended travel dates to South Africa. Do not plan your travel until you have the visa in hand.
