RETRENCHMENTS

Covid -19 has drastically changed how we interact in our personal lives and how we do business. Unfortunately, many businesses have to consider and implement different strategies to survive and to prosper into the future, which may include outsourcing, retrenchment and lay-offs.

There are factors that render dismissal for operational requirements (retrenchment) fair or not fair. If employer get it wrong, they can land up paying very heavy price.

Employers must follow the procedure as laid down in LRA to avoid being court out at CCMA and Labour Court for failing to follow procedure. Employers must fulfil its onus of proving that retrenchment was fair in all aspects.

With extremely high unemployment rate in South Africa, its very difficult for retrenchees to find new jobs. Therefore, courts DO NOT hesitate to protect the rights of retrenchees and make employers pay heavily where they deviate from law.
