PROTECTION OF PRIVATE INFORMATION ACT (POPIA) AUDIT AND TRAINING

The POPI Act has been implemented to ensure that institutions conduct themselves in a responsible manner when collecting, processing, storing and sharing another entity's personal information. The Act holds institutions accountable should they abuse or compromise personal information in any way. Personal information needs to be obtained fairly and lawfully; used only for the specified purpose for which it was originally obtained; adequate, relevant and not excessive to purpose; accurate and up to date; accessible to the subject; kept secure and destroyed after its purpose is completed

The POPI Act and regulations will come into full operation during 2020 and institutions will then have one year’s grace period to become compliant with the requirements for processing of personal information. Penalties of up to ten million rand can be imposed, as well as jail time, but reputational damage should be the biggest driver for compliance.

Institutions need to have a clear and concise plan when it comes to cyber breaches. It is vital that an audit takes place to determine which critical elements need to be protected. Organisations will need to have service level agreements with all contracting parties covering POPI aspects and assigning responsibility for protection of data.
