An important section of The Occupational Health and Safety Act clearly states what duties need to be followed by employers to ensure their employees Safety whilst on duty, more importantly it needs to be noted that it does not differentiate between industries but just merely an employer as this has caused some general confusion in the past where many believe that Health and Safety is only for the construction industry. It can't be stressed enough that all employers need to provide their employees with a healthy and safe working environment by following the duties as listed below:

1. Is to provide and maintain a working environment that is safe and without risk to the health of their employees. This includes all machinery, plant and systems of work.
2. To eliminate or mitigate and hazard that could arise during their working activities, with PPE being the last resort to be used to try mitigating some of the hazards.
3. Ensuring that were applicable health monitoring is in place when employees are making use of substances or materials that could adversely affect the health of the employee
4. To make the employee aware of what hazards and risks the employees are going to be exposed to during their course of employment and to provide precautionary measures. Employers must also provide employees training on these measures that have been taken and are to understand how to make sure these measures are in place at all times.
5. To provide information, instructions, training and supervision to ensure the health and safety of the employees.
6. Not allowing employees to work in circumstances where these measures are not in place.
7. Ensuring that The Occupational Health and Safety Act is being adhered to by all persons that are on their premises this could be employees, visitors, suppliers or inspectors and ensuring that these enforced.
8. Ensuring any plant or machinery that is to be used is, is used under supervision and that regular maintenance is being conducted by persons who have the applicable qualification to conduct maintenance activities.
9. Ensuring that all employees are aware of the duties that need to be conducted whilst in their employment
