❄️As June marks the peak of the flu season in South Africa, employers often see a surge in absenteeism. While genuine illness is a reality of winter, it is essential for businesses to maintain a balance between employee wellness and the prevention of sick leave abuse.

Protecting your operations starts with understanding your rights under the BCEA:

🔹The 2-Day Rule: Payment is not mandatory for absences of more than two consecutive days without a valid medical certificate.
🔹Patterned Absenteeism: Frequent "illness" surrounding weekends or public holidays warrants professional investigation and consistent policy application.
🔹Certificate Validity: To be legally binding, sick notes must be issued by a registered medical practitioner and meet specific criteria.

Don’t let absenteeism freeze your productivity. We provide the IR expertise to help you manage leave policies fairly and stay compliant throughout the winter months.

⚖️Termination during probation isn’t automatic. Procedure still matters.

Even when an employee is on probation under a fixed-term contract, employers can’t simply end the relationship without a fair reason and a fair process. Probation is there to assess suitability for the role, not to bypass labour law obligations.

Whether it’s performance concerns, misconduct, or operational issues, employers must still follow proper procedure – including giving the employee a chance to respond and checking the contract’s notice and probation terms. Ignoring this step can turn a simple termination into a legal dispute.

South African case law consistently reinforces this principle: fairness applies even during probation, and failure to follow process can lead to claims at the CCMA.

If you’re unsure how to manage probation terminations correctly, get guidance before taking action – it can save your business from unnecessary risk.💼

“But I told them”… is not a workplace system.❌

A lot of workplace issues start here, an instruction is given verbally, expectations are assumed, and then performance or behaviour goes wrong… and suddenly there’s confusion on both sides.

In employment law, “I told them” is not always enough. If instructions, expectations, or standards aren’t clearly communicated and consistently applied, it becomes difficult to enforce accountability fairly.

This is where many workplace problems quietly begin - not misconduct, but miscommunication.

💼Strong workplaces don’t rely on memory or assumptions. They rely on clear, consistent communication that everyone understands the same way.

Receiving a CCMA letter or summons is not just paperwork⚖️ - it’s the start of a formal legal process that requires immediate action.

Employers must respond, attend hearings, and submit documents on time as deadlines are strict. Missing a step can result in the case continuing without you.

📄Preparation is essential. You need proper records such as contracts, policies, warnings, and disciplinary documents, to properly defend your case.

It’s also important to understand the process. The CCMA begins with conciliation, where the focus is on settlement, not winning. How you respond here can determine whether the matter escalates to arbitration.

Ignoring notices or arriving unprepared can quickly turn a manageable dispute into a costly CCMA case.💼

Get expert support to manage CCMA matters correctly from the start - protect your business and stay compliant.

“Must have 5–10 years' experience”… but the salary says entry-level?💼

This is becoming one of the biggest disconnects in the job market. Employers want senior-level skills, independence, and fast results, but offer only junior-level pay in return.

The reality is simple: experienced employees don’t just bring skills, they bring speed, judgment, and the ability to hit the ground running. That level of value comes with the right compensation.

When expectations and pay don’t align, businesses struggle to attract the right talent, and vacancies stay open far longer than expected.

If you want experienced people, the offer must reflect experienced value. Otherwise, you’re not hiring a senior… you’re just describing one.

Changing a job title might look like a small admin update but it can have bigger consequences than expected.⚠️

A new title doesn’t automatically mean a promotion or a salary increase.

What really matters is what changes in the role:

▪️Have the employee’s duties and responsibilities changed?
▪️Is there now more accountability or a higher-level function?
▪️Was there any written agreement about a salary adjustment?

If these things are not clearly defined, a simple title change can easily create the expectation of a raise which can lead to confusion or disputes later.

The key is clarity. Always document role changes properly so everyone is aligned from the start.

❌Myth: I caught my employee stealing red-handed, so I can fire them on the spot without a hearing.

✅Fact: Even with "obvious" proof, procedural fairness is non-negotiable.

Under the Labour Relations Act 66 of 1995, every employee has the right to a fair procedure before dismissal. Skipping a formal disciplinary enquiry, no matter how solid the evidence, is a shortcut that often leads straight to the CCMA.

Even if the reason for firing is valid, not following the law can result in expensive compensation orders or reinstatement.

Don’t let a "clear-cut" case become a legal nightmare.

At SA Labour Help, we ensure your business remains fully compliant. From chairing disciplinary hearings to ensuring your documentation is airtight, we protect your business from unnecessary risk.⚖️
