The Evidence Leader says Mashaba claims he couldn't give information to a weighbridge. So why did he go to Yellow Jersey without any backup, but couldn't mobilize a team to monitor the weighbridge?
Mashaba said he wanted to verify the information.

Baloyi asks why Mashaba didn't get onto the property and open the truck container at Scania, stating that he didn't need the SAPS to be there. Baloyi says Mashaba could have called his colleagues. Mashaba says he needed the SAPS, but nothing would have stopped him from entering the premises, yet he still needed the SAPS.

Baloyi asks if Mashaba could have done what he did at Scania without involving the SAPS. Is there nothing that compelled him to bring SAPS into the operation?

Mashaba says if he had reasonable suspicion, nothing would have stopped him. He says nothing obliged him to bring in the SAPS.

Mashaba says he didn't bow to the civilian; he said he used his discretion. Madlanga asks, "By not complying with prescripts?" Mashaba said if the operation was unsuccessful, then he would have broken the law.
Madlanga wants a direct answer. He asks if Mashaba is entitled to use his discretion contrary to applicable prescripts. Mashaba says as long as the decision he has taken is successful, then yes.

Madlanga asks if Mashaba's exercise of discretion, contrary to prescripts, is unlawful. Mashaba disagrees. Madlanga says surely acting contrary to prescripts is unlawful. Mashaba says there was nothing unlawful. Madlanga says it's wrong at entry points. Mashaba says if we're not talking about this case, it's unlawful.

Madlanga says Mashaba chose to follow what Nku (a civilian) told him and breached prescripts. Mashaba justifies this by saying the bust was successful. Madlanga asks if the breach of prescript becomes irrelevant due to a fortuitous operation. Mashaba agrees. Madlanga says he'll end the debate by suggesting that Mashaba breached existing prescripts, and Mashaba accepts the breach. Secondly, Madlanga suggests that Mashaba's conduct was unlawful. Mashaba says he doesn't agree.

Mashaba asserts that the Criminal Procedure Act grants him the authority to deploy peace-keeping officers to combat and prevent criminal activity, emphasizing his reliance on this legislation. He states that this act confers upon him the requisite power and authority.

Madlanga inquired whether Mashaba would undertake investigations into serious offenses such as murder and robbery. Mashaba responded in the negative.

Madlanga then sought clarification regarding whether Mashaba would initiate an investigation into a murder or armed robbery even if no formal docket had yet been opened, specifically inquiring about his actions prior to the establishment of such official documentation.

Mashaba says not that out of his own way would he investigate a murder or robbery. He says he'd report to saps.
Madlanga asks what isn't that stops him from investigating armed robbery or murder.
Mashaba says he was dealing with traffic officing related matters. He says if a crime is brought to his incident he was report the matter.

Baloyi inquired about potential limitations and whether the crime was required to have occurred on the road. Mashaba confirmed that the incident needed to be road-related, but for other types of offenses, he would need to solicit assistance from the South African Police Service (SAPS). He further stated that once SAPS becomes involved, they can collectively address the operation.
