In Ukomelela we keep up to date with all legislation as best we can as to ensure that all our clients remain compliant with the various Acts as it is a needed practice.
With this in mind there was 2 new amendments to Labour laws namely Minimum wage and Earnings Threshold. The new minimum wage is therefore now at R 23,19 per hour worked. Of which Domestic workers have changed to this amount as well instead of being under the general minimum wage.
The earnings threshold is now at R 224 080,48 Per Annum(Year) or R 18 673,37 per month of which employees over this is excluded from certain sections of the BCEA while employees under this falls within the full protection of the BCEA.

As CCMA is giving out awards and finalising arbitrations concerning Mandatory Vaccination some arbitrations states that it is acceptable to have a mandatory vaccination policy while others state it is not acceptable.
An important thing to remember is that the Occupational Health and Safety Act’s Consolidated Determination of 2021 only allows a mandatory vaccination policy under certain circumstances of which a risk assessment needs to show that it is needed as one of the requirements and not that every workplace will be able to create and implement such a policy.
