Eskom Confirms No Fines or Disconnections for Unregistered Solar.
As of 13 August 2026, Eskom has officially confirmed that it will not fine residential customers or cut off their electricity supply for failing to register their rooftop solar systems by the 30 September 2026 deadline. This announcement follows significant pushback from legal experts and civil rights organisations regarding the utility's legal authority to impose such penalties.
Eskom spokesperson Daphne Mokwena confirmed to energy experts and the Organisation Undoing Tax Abuse (OUTA) that the utility lacks the statutory power to issue fines for unregistered Small-Scale Embedded Generation (SSEG) systems. Consequently, the previously threatened penalties of up to R30,000 and supply disconnections by Eskom are no longer enforceable by the power utility.
Legal Challenges and OUTA Intervention.
The reversal in Eskom's stance comes after OUTA and energy experts argued that Eskom, as a company registered under the Companies Act, is not a court or statutory authority empowered to levy fines. OUTA CEO Wayne Duvenage clarified that Eskom only has the authority to penalise illegal electricity connections, and under current legislation, unregistered SSEG systems are not classified as illegal.
