Although any industrial relations practitioner would like to promise victory and plain sailing to employers, this is unfortunately not realistic. Current legislation is extremely "worker centric" and changes annually to add to the subsequent frustration of employers. It is the function of WHM Labour Law Advisors to ensure that clients remain informed on these changes in legislation. This ensures that clients remain competitive in the market without being subject to unexpected changes, which need to be, implemented overnight on an ad hoc basis.
In the ex*****on of disciplinary procedures however, the IR practitioner will prepare the employer's case in such a way that the matter can be successfully challenged at the appropriate forum, ensuring a better rate of success. An improved success rate at the CCMA also implies the saving of client resources, due to the fact that compensation is not paid out to employees, who would otherwise not be entitled to such an award.
Our experience has shown that the monthly retainer paid to WHM Labour Law Advisors constitutes a considerable saving in moneys that would otherwise be paid out to unethical employees who lodge opportunistic applications at the CCMA.
WHM Labour Law Advisors also ensure that clients have legal recourse, which would otherwise be inaccessible to employers, unless they have the means to employ their own legal advice on a permanent basis. Experience has shown that legal practitioners who are well versed in labour matters are rare and expensive and will have limited success, unless an IR practitioner prepares the procedures in advance.
WHM Labour Law Advisors are well qualified to take on this considerable task. Both practitioners are well experienced in all aspects of labour law and litigation. Wim de Beer currently lectures labour- relations on advanced level at the University of Johannesburg whilst Hennie van Graan at the University of Johannesburg Soweto Campus is doing the same. Both practitioners are qualified academically up to honours level at the University of Pretoria and Rand Afrikaans University respectively with extensive experience in the security, retail, manufacturing and hospitality sectors.

A) This outsourced Human Resource (HR) service as discussed underneath will be rendered at a monthly retainer fee as negotiated with the client, payable in advance, excluding any travel expenses outside the Gauteng province.
The following functions will be provided at shop level. (At client’s premises)
24-hour help-line availability.
Conducting of difficult and sensitive disciplinary hearings on shop floor level
The preparation and compiling of labour related and CCMA documents
Support junior management in all IR procedures and disciplinary hearings.
Grievance procedures and retrenchments.

Training of personnel in all related IR and human resources procedures.
Updating of all contracts of service.
The strategic planning with regards to in house policies and procedures.
Management Training. (Middle and Junior Management in example disciplinary procedures)
Personnel Evaluation and support in merit appraisals.
B) Provision of all HR and labour law related documents. This service will be rendered at a once off fee of R4500, 00 payable in advance. (Please find attached the index of HR and labour law related documents that is included in the price)
This function includes:
Adapting all HR-related documents to company climate and culture.
Provision and updating of all contracts of service.
The supervision and negotiation with current staff in signing of contracts.
C) IR Training: 2 Day Course. (Gather evidence and chair a disciplinary enquiry)

Although an hourly rate of R850-00 per hour is also included in the proposal we have found that the retainer is cheaper in the long run especially where protracted support at disciplinary hearings and CCMA makes the hourly rate somewhat expensive.
