Why Estate Planning Matters

Without proper planning, taxes can reduce what your loved ones receive.

Estate planning isn’t just about finances — it’s about protecting your family and giving them clarity during a difficult time.

• Taxes can reduce inheritance
• Administration delays can slow down payouts
• Families may face unexpected financial pressure

Planning ahead helps avoid unnecessary stress and uncertainty when it matters most.

Post-Death Taxes

Did you know a deceased estate becomes a taxable entity?

Many people assume tax ends when someone passes away - but that’s not the case. During estate administration, several tax obligations may still apply:

• Estate Duty may apply if the estate exceeds R3.5 million
• Estate duty rates:
– 20% up to R30 million
– 25% above R30 million
• Income earned by the estate (like interest or rental) may still be taxable
• VAT obligations must be finalised, where applicable

Handling these correctly is a crucial part of winding up an estate.

What happens to someone’s tax when they pass away?

Many people are surprised to learn that tax responsibilities don’t end immediately.

Before an estate can be finalised, a final income tax return must be submitted. There may also be Capital Gains Tax triggered by the deemed disposal of assets, and any outstanding tax liabilities must be settled.

These important steps must be completed before the estate administration process can be concluded - helping ensure a smoother distribution to beneficiaries.

Did you know tax obligations continue after death?

When someone passes away, their financial responsibilities don’t automatically end. Before any inheritance can be paid, a deceased estate must still comply with important tax requirements.

Here’s what many families don’t realise:

▪ Taxes must be settled before beneficiaries can receive their inheritance
▪ A deceased estate must comply with legal and tax processes
▪ There are two key phases of taxes in estate administration:
• Pre-death taxes
• Post-death taxes

Understanding these obligations early can help families avoid delays, reduce stress, and prevent unexpected financial pressure.

Over the next few posts, we’ll be unpacking each of these tax phases to help you better understand what to expect.

If you own a business or company shares, your estate can take much longer to finalise when you pass away.

Under the Administration of Estates Act 66 of 1965, all assets in an estate must be properly valued and administered. When a business is involved, it often requires additional valuations, legal agreements, and tax considerations.

This can significantly delay the estate administration process.
