CONSTITUTIONAL COURT CLARIFIES CUSTOMARY MARRIAGES & ANTE-NUPTIAL CONTRACTS

The Constitutional Court has ruled that:
• A customary marriage is automatically in community of property once it is concluded, unless a court orders otherwise.
• An antenuptial contract signed after a customary marriage is invalid and has no legal force.
• Couples cannot privately change their marriage property system after marriage.
• Any change to the property regime after marriage requires a joint court application and court approval.

The Court emphasised that this rule exists to:
• Protect spouses (especially vulnerable spouses)
• Promote equality, fairness, and legal certainty
• Affirm that customary marriages are full marriages with full legal consequences.

Customary marriage is recognised and protected by law, but once it exists, its property consequences are governed by the Constitution and the Recognition of Customary Marriages Act.
