The Department of Employment and Labour has confirmed that more inspectors are being trained and the probability of an Employment Equity inspection has increased significantly. When an inspection occurs, non-compliance will be expensive.

First-time contraventions carry fines starting at R1.5 million per offence, with penalties reaching up to 2% of annual turnover for repeated failures. Beyond the financial penalty, a failed inspection puts your EE Certificate of Compliance at immediate risk, which directly affects your ability to participate in government procurement.

The public comment period on the 2026 Draft Amended B-BBEE Codes closes on 29 March 2026. These are not minor adjustments. The proposed changes include a centralised Transformation Fund, stricter procurement targets, and revised Enterprise and Supplier Development scoring.

If the amendments are gazetted in their current form, businesses that have not modelled the impact could face scorecard erosion, lost procurement points, or misallocated compliance spend.
