The Zambian Government will suspend Immigration Consultancy Services for three months beginning this Thursday the 28th March 2013. Its has been advised that consultants that will still have pending cases with the department will be given 10 working days from the effective date of the suspension to follow up on such applications. It has also been advised that the Immigration Department will not receive any new applications for permits and visas from immigration consultants during this period of the ban. As a result of this ban companies and individuals seeking such services would have to submit applications in person while companies and institutions would be mandated to submit and make follow-ups on the applications through their respective human resource personnel.
This ban comes in the wake of the new regulations that aims at realigning the work of the Immigration Department and aims at providing efficient services. These realignment are also to legitimise the work of Immigration Consultancy as the Department of Immigration realized that some people were masquerading as immigration consultants when they had little knowledge in Immigration matters and were in most cases misleading and swindling unsuspecting clients.
Another area of point i would like to share is that, the new Immigration and Amendment Act of 2010 in Article 47 section (1,2,3,4,5, 6 and 7) has recognized the need to have registered consultants and in the new regulations, consultants will be required to pay a prescribed fee unlike before. This is also one reason that has been associated with the suspension. This suspension is to allow the Department among other things 1. Come up with a prescribed fee, 2. Finalise Administrative Procedures with regards to where the prescribed fee will be deposited. At the moment, the Department together with the Ministry of Home Affairs are liaising with the Ministry of Finance to come up with a decision whether the Department can open up its own account to deposit the prescribed fee or if the money will have to go to the treasury (Ministry of Finance). 3. Also of importance to note is that, the Department is aiming to offer an efficient regulatory system that will improve its services and help to decongest the customer service center which has been operating below par. 4. The Department want to re-advertised a call for immigration consultants in line with the new act in order to come up with knowledgeable and qualified Immigration Consultancy Practitioners unlike in the past where anyone with a company can register. Strict interviews will be carried out and those that will be deemed competent will be selected and issued with a practicing license.
This decision will inconvenience a lot of companies who depend on consultants to make follow ups at the Immigration Department. I did make some inquiries and i was advised as follows, since a directive has been issued that after the expiry of the 10 days deadline, each company has to make follow ups through the HR Departments and it is incumbent upon each company to engage any consultant on an individual level and issued with an identification as proof that they are representing such a company or as p**f that they are employees of such a company. This can be on a short term basis depending on each company's preferences until the ban is lifted and i believe its an alternative in the interim and it will help a great deal. Some companies have limited HR personnel and it will be difficult to handle the strenuous and difficult task of follow ups at the Immigration Department since some companies are far away from Lusaka.
