Policy Brief: Decolonizing Zambia’s Legal System

1. Problem Statement

At independence (1964), Zambia inherited English common law and colonial statutes. While some laws provided early stability, several archaic colonial-era statutes remain in the Zambian statute books, despite being repealed or reformed in Britain and elsewhere. These laws are repugnant to constitutional rights, incompatible with democratic aspirations, and detrimental to human rights and the principles of governance.
2. Key Colonial and Archaic Statutes of Concern (20+)

- Penal Code (Cap. 87): Contains vagrancy offences and morality provisions rooted in Victorian law.
- Public Order Act (Cap. 113, 1955): Requires police permits for meetings and demonstrations.
- Societies Act (Cap. 119, 1957): Grants broad powers to deregister associations.
- Defamation of the President (s.69, repealed 2022): Criminalised criticism of the Head of State.
- Prisons/Correctional Laws: Historically punitive, only partially modernised in 2021.

- Human Rights Compliance: Archaic offences harm Zambia’s international standing.
- Development & Governance: Outdated laws undermine democratic governance and trust.
- Prison Congestion: Non-bailable minor drug offences overpopulate prisons, while serious offences such as defilement should instead be made non-bailable.
4. Policy Options
1. Do Nothing: Retain current framework — perpetuates rights violations.
2. Incremental Reforms: Repeal controversial provisions piecemeal.
3. Comprehensive Decolonisation Strategy (Recommended): Establish a formal process for systematic statute review.
5. Recommendations
Priority Actions (0–2 years):
- Repeal/amend Public Order Act and Societies Act.
- Modernise Penal Code.
- Fully integrate Correctional Service Act reforms.
- Review bail provisions to decongest prisons by making minor drug-related offences bailable while ensuring offences against the girl child (e.g., defilement, child trafficking) are non-bailable.

Medium-Term Actions (2–5 years):
- Establish Legislative Decolonization Commission.
- Harmonise customary law with constitutional guarantees.
- Revise legal education curricula.

Long-Term Actions (5+ years):
- Institutionalise statute law revision cycles.
