Following our recent reports on the tensions in Zambezi District, many readers have raised a critical point: DOES THE ZAMBEZI BOMA NOT SIT ON TRADITIONAL LUNDA SOIL? OR WAS CHIEF NDUNGU'S PALACE NOT IN THE EAST AT NGUJI BEFORE HE SHIFTED TO MIZE IN 1947 TO PAVE WAY FOR THE BOMA....???

At ZIN, our mandate is to provide context. To understand the current standoff between the Lunda and Luvale communities, we must understand the clash between TRADITIONAL GEOGRAPHY and STATUTORY LAW. Here are the facts driving the dispute:

๐Ÿ‘‘ THE TRADITIONAL CLAIM:

(a) "IT IS LUVALE SOIL"

The Luvale argue that Chief Ndungu only shifted in 1947 and left Chief Kasaka as an enclave on the East. Their 1800 graves where the Makishi masquerades emerge from Nguji for 70 years are a proof. Lunda lubanza is 43 years old. Baluvale was changed to Zambezi in 1969 to give the BOMA a none tribal name to suit one Zambia and not to hand over the BOMA to the Lundas.

(b) "IT IS LUNDA SOIL"

The Lunda Royal Establishment and its people argue that historically and geographically, the land upon which the Zambezi District administration (the BOMA) was built falls entirely under the jurisdiction of the Lunda traditional authority. From a historical perspective, they feel that government operations, and the subsequent settlement of other groups (like the Luvales) in the BOMA area, are happening on land that belongs to their ancestors. This is the root of the feeling of encroachment.

๐Ÿ“œ THE LEGAL REALITY: The Lands Act & State Land

While traditional history is deeply respected in Zambia, modern governance operates under statutory law. Under the Zambian Lands Act, land is divided into two main categories: Customary Land and State Land.
When an area is gazetted as a District Center (a BOMA), it is legally designated as STATE LAND. It is excised from traditional control and is held in trust by the President on behalf of ALL Zambians.

WHAT DOES THIS MEAN IN PRACTICE?

1. NO TRADITIONAL JURISDICTION: Once land is gazetted as a BOMA, traditional leaders (whether Lunda or Luvale) no longer have administrative or territorial jurisdiction over it.

2. EQUAL ACCESS: Because it is State Land, any Zambian - regardless of their tribe - has the constitutional right to live, trade, and access government services within the BOMA without seeking traditional permission or facing ethnic discrimination. There's no time when the other tribe will be erased or chased out of the BOMA.

THE ZIN VERDICT:

The tension in Zambezi is a tragic collision between historical pride and modern statehood. The Lundas and luvales both have a valid historical connection to the geography, but the BOMA itself operates under the strict, tribe-neutral laws of the Republic of Zambia.

The Ministry of Lands and the House of Chiefs must step in urgently. They must physically and legally clarify these boundaries to the public so that traditional heritage is respected without compromising the neutrality of government institutions.

TEACHER DEFICIT STILL HIGH AS GOVERNMENT ANNOUNCES 2,000 RECRUITMENT DRIVE โ€” SIYAKALIMA HINTS AT 30,000 MORE BY 2027

The Minister of Education, Douglas Siyakalima, has announced a new teacher recruitment exercise aimed at addressing the countryโ€™s growing education challenges, as learner enrollment continues to rise at both primary and secondary levels.

Speaking at a press briefing, the Minister noted that increased enrollment has placed significant pressure on existing education infrastructure and teaching personnel, making recruitment not just an administrative process but a strategic investment in the delivery of quality education.

Mr. Siyakalima revealed that Zambia is currently facing a teacher deficit of over 146,000, with pupil-teacher ratios remaining above recommended standards, particularly in rural and underserved areas.

He states that the recruitment of 2,000 teachers for 2025 will help ease the burden by improving staffing levels, decongesting classrooms, and strengthening critical subject areas such as science, mathematics, and ICT.

The Minister further emphasized that the recruitment process, to be coordinated by the Teaching Services Commission in line with public service procedures, will prioritize equity, transparency, and inclusivity, with 10 percent of positions reserved for persons with disabilities.

Looking ahead, Mr. Siyakalima disclosed that government remains optimistic about expanding recruitment efforts, indicating that if the current economic trajectory is sustained, more than 30,000 additional teachers will be recruited by 2027 to further bridge the staffing gap and improve the quality of education across the country.

He has warned that those in the habit of refusing rural areas when posted will disqualify themselves.

And the Commission says they are not using the old database but inviting new applicants discarding the 2023 database.
