“I think I’m underpaying my employees”

Fairwork have clear guidelines of the steps that need to be taken to remediate underpaid employees.

1. Work out how long the employee was underpaid.
2. Work out how much the employee was paid and how much the employee was entitled to be paid.
3. Calculate how much the employee has been underpaid.
4. Discuss with the employee and confirm backpay arrangements.
5. Ensure future state of payroll software and processes ensures this doesn’t happen again.

Most importantly , Fairwork expects you to advise them of this underpayment regardless of whether it has been rectified, especially if it’s been happening over a long period.

If Fairwork become aware of an underpayment they may start an investigation.

Directors are now more than ever being heavily fined for wage theft.

In a case that started from underpayment allegations our Inspectors received from two former workers that led to the discovery of widespread underpayment of entitlements across a network of sushi outlets, we’ve now secured $15.3 million in penalties against the former operators. The penalty includes $1.6 million against the owner and sole director of the companies.

“All employers must prioritise putting in place systems and getting the advice they need to ensure they are paying workers their lawful entitlements. Those who are doing the wrong thing, including large corporates, are being found out – and we don’t hesitate to take enforcement action where appropriate,” Fair Work Ombudsman Sandra Parker said.

In 2021-22, we recovered a record sum of $532 million in wages for 384,805 underpaid workers. This triples our 2020-21 record recoveries and is more than quadruple of that in 2019-20.

Have you been asked to show off your skills with an unpaid work trial?

Work trials are a genuine way for an employer to evaluate who’s suitable for a particular role.

But, unpaid work trials may be unlawful if:

• they aren’t necessary to demonstrate the skills required for the job, or have continued for longer than is actually needed (generally unpaid work trials can last for one hour to one shift, depending on the role)
• they involve more than only a demonstration of your skills
• you aren’t under direct supervision for the trial.

Any period you work beyond what’s reasonably required to demonstrate skills for the job must be paid at the appropriate minimum rate of pay.

We have back-paid nearly $400,000 in wages to 479 underpaid workers after investigating employers in Darwin’s food precincts.

Fair Work Inspectors targeted 48 businesses across 22 suburbs, including Darwin City, Casuarina and Palmerston City and found the majority were non-compliant.

Of the 34 businesses found to be in breach, 31 had underpaid their workers and 10 had failed to meet pay slip and record-keeping requirements.

The most common breaches were:
• failure to pay penalty rates or casual loading
• underpayment of the minimum hourly rate of pay
• failure to pay correct overtime allowances.

“We will continue to prioritise improving compliance in this sector and protecting vulnerable workers such as visa holders and students who are over-represented. Employers can use our free tools and resources if they need assistance meeting their obligations. Workers with concerns about their pay or entitlement should come forward for help,” says Fair Work Ombudsman Sandra Parker.
