WORK IN AUSTRALIA- Australia's work visa program changes was announced on 7 Dec 2024 and became effective with the new Skills in Demand Visa (SID) replacing the former Temporary Skills Shortage visa (TSS).

Foreign workers must have at least 1 full-time prior work experience in a nominated occupation. listed under the Core Skills Occupation List (CSOL): the new work visa list released yesterday. To date, the 2 confirmed streams : Core Skills Stream and Specialist Skills stream have been announced.
1) Specialist Skills stream: Workers would need to earn at least A$135,000 per annum, and no less than an Australian equivalent worker in the same occupation, and can be from any occupation listed on ANZSCO 2022 directory except ANZSCO group levels 3,7 and 8 (namely: trades workers, machinery operators and drivers/laborers)
2) Core Skills Stream: Workers can be sponsored under any of the occupations listed under the Core Skills Occupation List (CSOL).
The new work visa list was released yesterday.

Foreign workers under any of the CSOL listed occupations must earn at least the income threshold of AUD73,150/year.
They can now be eligible for a PR pathway through subclass 186 visa after 2 years of work in the occupation.

The new National Innovation Visa (known as the NIV) replaces previous subclass 858 Global Talent visa with effect from 7 Dec 2024. This is an exclusive program for international candidates who can bring their world-leading skills areas (eg: quantum computing, clean energy or advanced robotics) to Australia. People from other possible industries may be considered as well: such as in critical technologies, low emission & renewable technologies and health industries. If you are a recipient of internationally prestigious awards such as Nobel Prize, Booker Prize or an Olympic gold medallist, you may also be considered. You will need to submit an expression of interest (EOI) and be invited to apply if selected.

There is no age limit for the NIV. It is a permanent residence visa.

NEW STUDENT VISA RULE:
From 1 Jul 2024 onwards, an application for a student visa while onshore in Australia will no longer be allowed if you hold any of the following visas:
Subclass 485 (Temporary Graduate)
Subclass 600 (Visitor)
Subclass 601 (Electronic Travel Authority)
Subclass 602 (Medical Treatment)
Subclass 651 (eVisitor)
Subclass 771 (Transit)
Subclass 988 (Maritime Crew)
Subclass 995 (Diplomatic Temporary) – primary visa holders only
Subclass 403 (Temporary Work) International Relations)) – Domestic Worker (Diplomatic or Consular) stream
Subclass 426 (Domestic Worker (Temporary) – Diplomatic or Consular)
Instead, if you hold any of the abovementioned visas, you will have to apply for your student visa while physically offshore or in your home country.

The closing of the subclass 188 Business Innovation visa . From 1 July 2024 onwards, no new applications will be accepted. However, all existing 188 applications already lodged will continue being processed. You also have the option of withdrawing and seeking a refund for your VAC if you wish to opt out of an ongoing 188 visa application
Note: All subclass 888 applications for those who hold subclass 188 visas will remain open.

PROPOSED CHANGES TO SUBCLASS 485 CRITERIA
Subclass 485 Temporary Graduate Visa (Post Study Work stream). The initial announcement by the Australian Dept of Home Affairs that from 1 Jul 2024 onwards: all students who had graduated from Australian education institutions and satisfying the Australian study requirements would only be eligible for the subclass 485 visa if under the age of 35, was recently revised to extend a grandfathering eligibility for certain categories of students. This means even if you are over 35 years of age but have not the age of 50, AND completed:

1) a Phd doctoral degree
2) a Masters degree by research; OR
3) are Hong Kong and Hong Kong (BNO) passport holders -for all course qualifications (both university and vocational studies), you would be eligible for the subclass 485 visa.

From GTE to GST for student visa applications

As of 23 Mar 2024, the Australian government has imposed new criteria guidelines for all students applying on 23 Mar 2024 onwards. The normal Genuine Temporary Entrant (GTE) requirement is now replaced with Genuine Student Test (GST). This change is to help assess the student's genuine intention to study based on the applicant's circumstances, evidence of course progression, visa history, compliance with visa conditions, etc.
The GST does acknowledge that post-study pathways to permanent residence are available to eligible graduates unlike the previous GTE requirement.

Minimum English requirements for different education courses would apply as per the following chart:
