Can a poacher shoot a fake deer at night and then claim entrapment? A lot of people think game wardens using deer decoys is some kind of legal trick that should get thrown out, but a Vermont Supreme Court case says otherwise. Wardens had complaints about illegal night hunting, so around 9 p.m. they set a fake deer 83 feet off Town Road 23 in Greensboro, made out of styrofoam, wood, deer hide, a mounted deer head, and reflective tape over the eyes. Then they watched Benny Curtis drive slowly down the road, shine a bright light on it twice, stick a .22 rifle out the driver’s window, and shoot it right in the eye. He appealed by arguing it was legally impossible because the deer wasn’t real, and raised the entrapment issue too, but the court affirmed his conviction. In plain English, he didn’t get in trouble because he killed a fake deer. He got in trouble because he thought he was illegally shooting a real one.

Working around the yard with an audience from mother nature come to see what we’re doing. We’re lucky we have a lot Dearin and we see the occasional bear sometimes cougars but I guess that’s part of living in town.
