PRIVATE SECURITY REGULATION ACT 2005
STATEMENT OF OBJECTS AND REASONS
PSARA TRAINER

Due to increase in the number of business establishments and increasing demands for security, there has been a proliferation of private security agencies in the recent years. The growing tendency to hire security guards from private sources by industrial or business undertakings has led to coming up of large number of private security agencies all over the country.
Though these private security agencies have helped in meeting the security needs of business establishments, there has been a growing concern about the manner of functioning of these agencies, many of which seem to conduct their operations without due care for verifying the antecedents of the personnel employed as private security guards and supervisors.
Private multi-national security agencies have also established their branches in the country, which unless properly regulated, may have serious security implications. Unless suitable safeguards are devised, these developments are likely to have wide ranging security implications, which may not be in national interest. There is also a danger of the employees of the private security agencies encroaching upon the duties of the police, using weapons in an illegal manner and wearing uniforms which resemble those of the police. In many instances, personnel employed by these agencies have also been involved in criminal activities.
For all these reasons, Union Government has been considering to regulate the functioning of these private security agencies, so that they are run within legal parameters and are also accountable to a regulatory mechanism. In view of above, it is proposed to regulate the private security agencies through an Act which provides for a Controlling Authority to be appointed by State Governments for the purpose of granting licenses and also to make holding of licenses mandatory for the carrying on of business of security agencies and other related matters.

This Accordingly Private Security Regulation Act 2005 and the Model Rules was formulated. In Tamilnadu the Act and Model Rules were implemented in 2009 by Government of Tamilnadu.

RIGHTS OF PRIVATE DEFENCE
Private Security Professional should be clear to know the Rights of private defence of Indian penal code (IPC) Acts from 96 to106.
Act 96:--
Things done in Private defence---
Nothing is an offence which is done in the exercise of the private defence..
Act 97:-
Right of private defence of the body and property.
Every person has a right to the restrictions contained in section 99 to defend..
First- His own body and the body of other person, against any offence affecting the human body.
Secondly--- The property, whether movable or Immovable, of him or anything other person, against any act which is an offence, falling under the definition of theft, robbery, mischief or criminal trespass or which is an attempt to commit theft, robbery, mischief or criminal trespass.
Act 98:-
Right of private defence against the act of a person of unsound mind.
When an act, which would otherwise be a certain offence is not that offence by reason of the youth, the want of maturity of understanding, the unsoundness of mind or the intoxication of the person doing that act, or by reason of any misconception on the part of that person, every person has the same right of private defence against that act which he would have if the act were that offence.
Act 99:-
Acts against which there is no right of private defence.
Extend to which the right may be exercised.
Act 100:-
When the right of private defence of the body extends to causing death.
The right of private defence of the body extends. Under the restrictions mentioned in the last proceding section., to the voluntary casuing of death or of any other harm to the assailant, if the offence which occasions the exercise of the right be of any of the description hereinafter enumerated namely.
1. Such an assult as may reasonably cause the apprehension that death will otherwise be consequence of such assult.
2. Such an assult as may reasonably cause the apprehension that grievous hurt will otherwise be the consequence of such assult.
3. An assult with the intention of committing r**e.
4.An assult with the intention of gratifying unnatural list.
5.An assult with the intention of kidnapping or abducting.
Act 101:-
When such right extends to causing any harm other than death.
Act102:-
Commencement and continuance of the right of private defence. Of the body.
Act103:-
When the right of defence of property extends casuing death.
Robbery, House breaking, Mischief
and Theft comes under
Act 104:- when such right extends to causing any harm other than death..
Act 105.:-
Commencement and continuance of the right of private defence of property.
Act 106:-
Right of private defence against deadly assult when there is risk of harm to innocent person
