𝑺𝒆𝒍𝒇-𝒆𝒎𝒑𝒍𝒐𝒚𝒆𝒅 𝒂𝒏𝒅 𝒂 𝒑𝒂𝒓𝒆𝒏𝒕? 𝑨 𝒏𝒆𝒘 𝒑𝒂𝒓𝒆𝒏𝒕𝒂𝒍 𝒍𝒆𝒂𝒗𝒆 𝒃𝒆𝒏𝒆𝒇𝒊𝒕 𝒎𝒂𝒚 𝒏𝒐𝒘 𝒂𝒑𝒑𝒍𝒚 𝒕𝒐 𝒚𝒐𝒖. 👨‍👩‍👧

From 1 January 2026, eligible self-employed parents in Malta are entitled to four months of parental leave per child, to be taken in accordance with the applicable conditions before the child reaches eight years of age. Up to eight weeks are paid through the Department of Social Security.

𝑺𝒐, 𝒉𝒐𝒘 𝒅𝒐𝒆𝒔 𝒊𝒕 𝒘𝒐𝒓𝒌?

- The first two months (eight weeks) are paid and cannot be transferred to the other parent.
- The remaining two months are unpaid, but may be transferred between parents.
- Leave must be taken in blocks of at least two consecutive weeks.
- The benefit is paid for two weeks at a time, after the parent returns to work, at a rate linked to the Department of Social Security’s Married Sickness Benefit rate for that year.

The same entitlement extends to eligible adoptive and foster parents.

To qualify, applicants must meet a number of conditions, including having been self-employed for at least six months immediately before taking parental leave and having paid at least 20 Social Security contributions during the preceding two years.

Part-time self-employed parents may also qualify, subject to specific conditions.

Applications are submitted online to the Department of Social Security and must be made within six months of returning to work.

It’s been one year since DFK Malta moved into our new offices at the Central Business District in Birkirkara.

New Conditions of Work Regulations, effective from 29 June 2026, have replaced the former Wage Regulation Orders (WROs), introducing a number of important changes for employers.

Key updates include:

✔ A single minimum wage, regardless of age
✔ Sick leave entitlement across all sectors from the first day of employment, on a pro-rata basis
✔ Free provision of uniforms and PPE, with restrictions on wage deductions
✔ Standardised special leave entitlements, including marriage and bereavement leave
✔ Clarification that certain standby and waiting time constitutes paid working time
✔ New provisions governing tips within the Hotels & Clubs sector
✔ More favourable provisions contained in collective agreements will continue to prevail

These changes may require employers to review their employment contracts, HR policies and internal procedures to ensure compliance.

💬 Abigail: One of the tasks I find most interesting is audit planning for new clients. I enjoy getting to understand new clients and their business, and I also find the audit fieldwork process engaging because every audit brings something different to learn.

Maintaining accurate and up-to-date beneficial ownership information is a key compliance obligation for companies operating in Malta.

Recent amendments to the Beneficial Ownership Regulations, introduced through Legal Notice 184 of 2026, require businesses to review their existing ownership and control structures and ensure they continue to meet their reporting obligations.
