Ok, before everyone gets their panties in a bind over the ATF announcement on Friday, 9 October, let me clarify what the ATF said and what it means for Michigan. This past Friday the ATF sent an open letter to all FFL's and made a public statement that the:

"ATF would no longer be enforcing any requirements for individuals to apply and receive ATF approval before making or transferring short-barreled ri**es, short-barreled sh****ns, suppressors (silencers), and certain other concealable fi****ms known in the law as any other weapons. ATF also will not enforce the NFA’s registration, tax-stamp or related requirements for those covered items. The $200 tax remains in place for machine guns and destructive devices. The NFA requirements apply in full to those weapons. The guidance does not supersede state and local laws that restrict NFA fi****ms."

What the ATF stated here is that ALL INDIVIDUALS are no longer required to file Form 1/4's for the stated NFA items. Not just those named in the Texas Federal ruling back in August. Let me restate that in plain language, "NO ONE in the entire 50 States are required to file these forms", according to the ATF policy.

However............Here's the kicker for Michigan, (And we are not alone). Read the last line of the ATF's statement: "The guidance does not supersede state and local laws that restrict NFA fi****ms."

Michigan law historically restricts short-barreled ri**es, short-barreled sh****ns, and fi***rm silencers/suppressors, with exceptions tied to federal NFA compliance. In other words you must follow the NFA requirements that state you must file the correct form for a Tax Stamp. Here is why.

The National Fi****ms Act STILL EXISTS! Only congress can eliminate that law and until that time State law requires us law abiding citizens to have our NFA items registered and a tax stamp available. There are currently two bills that have been introduced in the Michigan House, HB6284/6285, that seek to eliminate the Michigan requirements. They have been introduced and read but no movement. Until these laws are passed, (not likely with our current government administration), or congress eliminates the NFA we are still stuck with the current requirements here in Michigan. Write or call your current congressperson or senator at both the state and national levels to see if we can get some kind of relief from this stupid law.

I am still waiting on the reaction to the ATF statement from the Michiagn State Police and local law enforcement as to what their policy is going to be. As the ATF statement was on Friday, I do not expect any statement until this coming week.

Ok, here we go! Before everyone calls and say they want to buy a suppress0r or SBR, SBS, we need to let you know how this NFA ruling played out. Especially for Michigan. On 5 August, 2026, Judge James Wesley Hendrix of the U.S. District Court for the Northern District of Texas enjoined the federal government from enforcing certain NFA provisions against the plaintiffs. which included 15 states as well as a coalition of businesses and advocacy groups. His 66 page ruling basically stated that the 1934 NFA Act was now unconstitutional since the Congress eliminated the $200 Tax Stamp Fee in last year's Big Beautiful Bill which took effect on 1 January of this year. He also issued a 7 day delay so the DOJ could appeal the ruling before the court order went into effect. Well, that 7 days lapsed at 12:01 this morning, (Thursday), with no appeal from the DOJ. So effective as of today, there is no requirement to file a Form 1 or Form 4 to purchase an NFA item. Now here is the kicker. The court order was NOT country wide. It only covered the states, business, groups, and persons that filed the original lawsuits, (there were two that were combined), against the federal government. This did NOT include the State of Michigan! You still have to file the proper forms and wait for your tax stamp if you live in Michigan and a dozen or so other states. Also, the DOJ still has 53 more days to file an appeal to the order. This can turn around if the DOJ files and wins an appeal. In a sense that would not be a bad thing as then it would eventually end up in the Supreme Court and the court in general leans toward the 2A. The NFA Act has been defended in the Supreme Court a couple of times and has always stood based on it being a tax. That tax is no longer in effect which makes the NFA Act unconstitutional. This ruling still left in place the NFA for machine guns and explosives. Have heart Michigan! Our time is coming!
