Ok, here we go! Before everyone calls and say they want to buy a suppress0r or SBR, SBS, we need to let you know how this NFA ruling played out. Especially for Michigan. On 5 August, 2026, Judge James Wesley Hendrix of the U.S. District Court for the Northern District of Texas enjoined the federal government from enforcing certain NFA provisions against the plaintiffs. which included 15 states as well as a coalition of businesses and advocacy groups. His 66 page ruling basically stated that the 1934 NFA Act was now unconstitutional since the Congress eliminated the $200 Tax Stamp Fee in last year's Big Beautiful Bill which took effect on 1 January of this year. He also issued a 7 day delay so the DOJ could appeal the ruling before the court order went into effect. Well, that 7 days lapsed at 12:01 this morning, (Thursday), with no appeal from the DOJ. So effective as of today, there is no requirement to file a Form 1 or Form 4 to purchase an NFA item. Now here is the kicker. The court order was NOT country wide. It only covered the states, business, groups, and persons that filed the original lawsuits, (there were two that were combined), against the federal government. This did NOT include the State of Michigan! You still have to file the proper forms and wait for your tax stamp if you live in Michigan and a dozen or so other states. Also, the DOJ still has 53 more days to file an appeal to the order. This can turn around if the DOJ files and wins an appeal. In a sense that would not be a bad thing as then it would eventually end up in the Supreme Court and the court in general leans toward the 2A. The NFA Act has been defended in the Supreme Court a couple of times and has always stood based on it being a tax. That tax is no longer in effect which makes the NFA Act unconstitutional. This ruling still left in place the NFA for machine guns and explosives. Have heart Michigan! Our time is coming!
