We Are Industry: How Industry-Embedded RTOs Can Prove They Meet Standard 1.2

For RTOs that operate inside the industry they train for- pest control firms, construction companies, aged care providers, allied health practices- industry engagement under Outcome Standard 1.2 is not a compliance activity bolted onto the business. It is the business. The paradox is that the more embedded the engagement, the more invisible it becomes, and the harder it is to evidence at audit. This article examines what Standard 1.2 requires, why authentically engaged providers often struggle to prove it, and how to build an evidence framework around what already happens, and what it means for industry-embedded RTOs, their assessors and the regulators assessing them.

"We Are Industry": The Operators Who Live Inside the Workplace

There is a phrase that surfaces regularly in conversations with a particular type of RTO operator. It comes up in compliance workshops, in audit preparation meetings, and in the quiet frustration of late-night documentation sessions. The phrase is simple: "We are industry." It is spoken by pest control business owners who also train technicians. By construction company directors who deliver apprenticeship programmes. By aged care providers who run their own RTOs to ensure workforce competence. By allied health practices that have built training arms because no external provider understood their clinical reality well enough.

These operators do not engage with industry in the way Standard 1.2 might traditionally suggest. They do not schedule quarterly advisory committee meetings with external stakeholders to gather feedback on their training and assessment strategies. They do not email employers asking whether their units of competency still reflect current practice...

Fit for Purpose Is a Test, Not a Description: Facilities, Resources and Equipment Under Outcome Standard 1.8

An RTO can hold the best trainers, the most rigorous assessment system and the most supportive enrolment process, and still produce graduates who are not workplace-ready if the facilities, resources and equipment they trained on do not reflect the industry they are entering. Outcome Standard 1.8 turns four plain words, fit for purpose, safe, accessible and sufficient, into four auditable tests. This article sets out what each test requires, how third-party and workplace delivery change the picture, and what it means for RTOs, auditors and the learners whose qualifications must mean something to the next employer.

Trained for a Qualification, or Trained for a Job

An RTO can have the best trainers in the sector, the most rigorous assessment system and the most supportive enrolment process, and still produce graduates who are not workplace-ready if the facilities, resources and equipment they trained with do not reflect the reality of the industry they are entering. A student who learns commercial cookery on domestic kitchen equipment, or electrical work with tools that have not been used in the trade for a decade, or aged care in a classroom with no simulated care environment, has been trained for a qualification, not for a job. Outcome Standard 1.8 of the Standards for RTOs 2025 exists to close that gap.

Outcome Standard 1.8 requires that facilities, resources and equipment for each training product are fit for purpose, safe, accessible and sufficient. These are not aspirational descriptors. They are four distinct regulatory tests, each of which must be met, each of which is auditable, and each of which is a frequent source of non-compliance findings...

The Commission Rule Most Providers Still Do Not Know About: Why Paying Agents for Onshore Transfers Becomes a Compliance Breach From 31 March 2026

From 31 March 2026, paying an education agent a commission to recruit an overseas student who has already commenced study onshore with another provider is no longer a commercial choice. It is a breach of the National Code. The ban arrives through the National Code Amendment (Education Agent Commissions) Instrument 2026, sitting under the Education Legislation Amendment (Integrity and Other Measures) Act 2025, which passed the House of Representatives on 28 November 2025 and received Royal Assent on 4 December 2025. This article sets out what the law now says, the narrow exceptions, the governance and transparency obligations that come with it, and what it means for CRICOS-registered providers, their boards and the agents they work with.

A Legislated Prohibition, Not a Guideline

There is a regulatory change that will fundamentally alter how CRICOS-registered providers manage their education agent relationships, and a significant portion of the sector appears to be unaware of it. From 31 March 2026, under amendments to the National Code of Practice for Providers of Education and Training to Overseas Students, registered providers are prohibited from paying education agent commissions for the recruitment of overseas students who have already commenced study onshore with another provider.
