Settlement day is one of the most exciting days in the property journey.

It’s also the day everyone discovers just how many moving parts are involved behind the scenes.

Sometimes delays happen because paperwork is incomplete. Sometimes a document is missing. And sometimes the bank simply isn’t ready when settlement is due to occur.

While we can’t control the bank, we can stay on top of the process, communicate with all parties, and work to resolve issues as quickly as possible.

No need for a review of a property contract?!?!

Ummm.. not on our watch. 👀

Buying or selling property in Queensland means needing to be aware of clauses, terms, additions, deposit details, easements and encumbrances, settlement and unconditional items, and more.

Plus, contracts can hide all sorts of adjustments.

Just recently we found a listed dishwasher when there never was one in the property. If we hadn’t picked that up, our Seller would have been out of pocket 1 new installed dishwasher. Now, that’s one of the more simpler issues we’ve uncovered when reviewing a contract of sale.

A delayed deposit payment on a property purchase does not sound like something that could destroy someone financially.

But this case ended up in the Supreme Court.

An Aussie buyer reportedly spent more than $200,000 in legal fees fighting for the right to buy a property after a deposit payment was delayed.

The seller terminated the contract.
The buyer lost the property.
And the seller had the right to keep the $98,500 deposit.

The buyer believed the delay had effectively been approved through conversations with the real estate agent.

The court disagreed.

This is why property contracts matter so much.

One clause.
One deadline.
One misunderstanding.



That is sometimes all it takes for a normal property purchase to become a legal and financial nightmare.
