Days before a visa expired. Multiple legal issues. ILR approved.

The Home Office has started reviewing some Pre Settled Status holders. If you’ve received an email titled “Minded to Curtail”, it means the Home Office is considering cancelling your status.

The important thing to remember is: this is not a final decision.

Before making a decision, the Home Office will give you an opportunity to provide evidence and explain your circumstances.

These emails are usually sent when the Home Office believes someone may have spent too much time outside the UK and no longer meets the continuous residence requirement.

If you receive this notice:
✔️ Don’t ignore it.
✔️ Read it carefully.
✔️ Seek legal advice as soon as possible if you’re unsure how to respond.

Every case is different, and responding promptly could make a significant difference to the outcome.

One of the most common misconceptions is that to qualify for ILR under the 10 Year Long Residence route, you must spend all 10 years in the UK on the same visa.

In fact, different immigration categories can count towards the 10 year qualifying period, including:

✔️ Student Visa
✔️ Graduate Visa
✔️ Skilled Worker Visa
✔️ Family Visa
✔️ Global Talent Visa

The key requirement is that your residence in the UK has been lawful and continuous throughout the 10 year period.

It is also important to remember that some categories do not count towards Long Residence, including Visitor Visas and certain short term immigration permissions.

Another point many people are unaware of is that time spent in the UK as a dependant or as a child may also count towards the qualifying period in certain circumstances.

If you have been living in the UK for many years and have changed visa categories along the way, you may be closer to ILR than you think.
