How does the Freedom of Information Law affect data protection?

When a person makes a request for their own information, this is a Subject Access Request under the Data Protection Law. However, members of the public often wrongly think it is the Freedom of Information Law that gives them the right to their personal information.

The Data Protection Law exists to protect people’s right to privacy. The Freedom of Information Law is about removing unnecessary secrecy.

We’re at Romerils, Dumaresq Street until 1pm today advising islanders, including small business owners, about local data protection law, its rights and obligations.

We’ve had some great conversations with business owners so far, ranging from practical guidance about how to keep personal data safe and the purpose it’s being used, to how to store it and how long to keep it for.

If you failed to renew and pay your data protection registration for this year you must act now, to avoid legal action.

Despite previous reminders from us, a number of organisations remain non-compliant with their legal obligations under the Data Protection Authority (Jersey) Law 2018 and the Data Protection (Registration and Charges) (Jersey) Regulations 2018.

Final formal letters are being issued.

If you receive a final formal letter correspondence from us, you should contact us without delay to avoid further action. You can do so by calling us on 01534 716530 or emailing us at [email protected]

Remember, if processing (using) personal information, no matter the volume, it is a legal requirement to be registered with our office. It is a criminal offence to process (use) personal information without being registered with us.

Another productive week for our team, marked with enforcement activity and a strong programme of community engagement. Highlights:

🌍 Joined an international call exchanging insights and learnings with data protection authorities worldwide.
⚖️ The Information Commissioner ran a Board Support session to give the view from the regulator.
🏫 Ran 'Protecting My Personal Information' sessions for Year 7 students at De La Salle and Les Quennevais schools.
🎓 Explored data protection principles, lawful bases and data security with second‑year Social Work students at Highlands College.

Next week, we’re:

🛡️ Monday 15 June: Chatting with Islanders, including small business owners, at our pop‑up stand at Romerils, Dumaresq Street (11am–1pm).

⚖️ Tuesday 16 June: Meeting Jersey’s legal sector to run through topical data protection issues. Thank you The Law Society of Jersey for arranging.

🛡️ Thursday 18 June: Presenting about how the new Cyber Security (Jersey) Law 2026 works alongside the Data Protection (Jersey) Law 2018.

Anyone can make a freedom of information request, they don’t have to be Jersey citizens or resident in Jersey.

Requests can also be made by organisations such as a newspaper, a campaign group or a company. The purpose is to embrace a culture of public openness, transparency and accountability.

The FOI Law doesn’t give people access to their own personal data such as their health records or credit reference file. These types of requests should be made under the Data Protection (Jersey) Law 2018.

Loving the feedback from our Let's Go DPO session 'Strengthening Your SARs Decision Making': "Very informative and great audience interaction."

➤ Our team left no stone unturned when it comes to our investigations and enforcement activities into complaints relating to Subject Access Requests. We're planning the next Let's Go DPO session. Watch this space.
➤ Young Islanders joined us for guidance sessions at Le Rocquier and our live, mock trial Courtroom Challenge at Hautlieu. Thank you Advocate Davida Blackmore for presiding.
