Heads up if you've ever tried to leave a POS contract. On October 29 the FTC and eight states sued Toast over fees, add-ons and how hard it is to cancel. The complaint says canceling takes 30 days' written notice that isn't spelled out at signup, that leaving early costs $150 for every month left on the contract, and that one owner was billed $5,318.87 after four years. It also says a Toast Capital loan comes due in full if you switch. Toast disagrees and says it will fight the case, so these are allegations, not findings.

Whatever system you run, I'd want three answers in writing before signing: how do I cancel and with how much notice, what do I owe if I leave early in dollars per month, and what happens to the hardware and any loan tied to the account. Any provider should answer those in plain words, us included.

Worth ten minutes this week: in court filings reported October 8, the FTC asked a federal court to make Block hand over records on frozen and deactivated Square accounts. The filing cites more than 1,500 complaints and up to $2.5 million in restricted funds since 2022, some from sellers who had already passed identity and bank verification. Block says it is working in good faith with the agency. It is an investigation, not a finding.

The lesson is not about one company. Every processor can hold funds after a sales spike, a run of chargebacks or a new product line. Get three things in writing before you need them: what triggers a hold, how long a review can take, and a phone number that reaches a person. And keep two weeks of payroll in a bank your processor does not control.

For anyone pricing a self-order kiosk: Square launched a new one on October 14, $1,999 with a 21.5 inch screen, a voice layer that takes the order and payments built in. The box is the smallest line. Software is $99 a month per kiosk plus $49 a month for Square Plus, so one kiosk on Plus runs $7,327 over 36 months, before card processing at 2.5% plus 15 cents.

None of that makes it a bad buy. A kiosk earns its keep by lifting the average ticket and taking the orders your counter cannot. Count those at your volume first, then put the number against $148 a month in software and the box.
