Bright Line Investigations LLC is closely monitoring the impact of Wisconsin Act 150 on criminal defense, civil rights, and defense investigation practice.

This law requires subpoenas for law enforcement officers, public officials, and public employees testifying about actions taken in their official capacity to be served at their work address. While it is being presented as a safety and professionalism measure, it also raises legitimate concerns about access, accountability, and due process.

In cooperative cases, agency service may work without issue. The real test comes in the hard cases: misconduct investigations, Brady and Giglio issues, hostile agencies, contested official conduct, and compressed trial timelines where rebuttal or compulsory witnesses become critical on short notice.

When the only lawful path for service runs through the same institution that may have an interest in delay, resistance, or damage control, the risk is obvious. A constitutional right to compulsory process must be meaningful in practice, not merely theoretical on paper.

Bright Line Investigations LLC will continue to monitor how this law is applied in the real world and how it affects defense access to witnesses, due process protections, and accountability in cases involving government actors.

As the 14th anniversary of Brian Banks’ exoneration approaches, his case remains one of the clearest examples of why professional investigative work matters.

When the system had stalled and no new evidence existed, a private investigator helped lawfully document the truth in a way that could finally be used. That moment changed the course of the case and helped correct a devastating wrongful conviction.

Cases like this remind us that justice does not always happen on its own. Sometimes it takes persistence, strategy, and a skilled investigator who knows how to find, preserve, and document evidence the right way.

Bright Line Investigations is proud to share a behind the scenes look at a recent claims investigation that reached resolution in 2026, supported in part by surveillance video obtained during an assignment in the summer of 2024.

This case required disciplined fieldwork, strong legal and ethical compliance, and patient documentation; including a 60 mile mobile surveillance tail that helped capture activity relevant to the claim. The resulting video and reporting contributed to an outcome grounded in accountability.

Public notice from Bright Line Investigations LLC:

This matter arose in a traffic court proceeding. That distinction does not diminish constitutional requirements. Traffic cases are still adjudicatory proceedings where the court exercises judicial power, enters judgments, and imposes penalties. Due process, separation of powers, and the requirement of lawful judicial authority still apply.

In this proceeding, the official court minutes reflect a prosecutor of record as present. The verbatim transcript, however, shows no prosecutor participating, observing, or appearing in any capacity. That discrepancy is not harmless. Court minutes are representations of what occurred. When the transcript contradicts those minutes, it raises serious concerns about the integrity of the judicial record.

A traffic designation does not permit paper participation, phantom appearances, or substitution of roles. The absence of a prosecutor does not authorize law enforcement to fill a judicial or adjudicatory function. Even where a judge is physically present, judicial authority cannot be delegated, outsourced, or implied. Constitutional rights cannot be waived by silence, convenience, or routine practice.

Across the United States, in every state, a plea related act or adjudication must be conducted by a neutral judicial officer exercising judicial authority, based on an accurate record of who was present and what occurred. False or misleading court records, even in traffic cases, implicate due process, ethical obligations, separation of powers, and public trust in the courts.

Bright Line Investigations exists to document and analyze systemic practices that cross constitutional boundaries, especially when those practices become normalized in routine proceedings. Fundamental rights do not change based on the label attached to the case.
