South Africa’s skills needs are changing.

Preliminary findings from Xpatweb’s 2026 Critical Skills Survey indicate that engineering, while still in demand, is no longer at the front of the list of skills employers are struggling to source.

The preliminary findings come from responses across sectors including agriculture, healthcare, transport and logistics, professional services, construction, ICT and telecommunications and tourism.

For businesses, changing skills needs are a reminder to connect workforce planning with Skills Development.

The question is whether the organisation is building the capabilities it will need next, over and above the B-BBEE points that training earns them.

The High Court has set aside the promulgation of the Legal Sector Code. What happens next matters for transformation in the legal profession.

In a judgment handed down by the Gauteng Division of the High Court, Pretoria, on 7 October 2026, the Court reviewed and set aside the Minister of Trade, Industry and Competition’s decision to promulgate the Legal Sector Code under section 9(1) of the B-BBEE Act.

The Court found that the Minister had not exercised the statutory discretion required of him when deciding to promulgate the Code. The matter has therefore been remitted to the Minister for reconsideration.

Importantly, the judgment does not determine that transformation in the legal profession is unlawful or that a sector-specific code cannot be introduced. The Court expressly recognised the constitutional imperative for transformation and the continuing need to address structural inequalities within the profession.

For businesses and professionals navigating B-BBEE, the decision is worth watching. The next steps taken by the Minister could have implications for how transformation within the legal sector is measured and implemented.

The 2026 Employment Equity reporting period is now open.

For designated employers, this is an important point in the reporting calendar. The current online submission deadline is 15 January 2027, while manual and posted EE reports will not be accepted after 1 October 2026.

The B-BBEE Commission’s transformation research analysed more than 28,000 B-BBEE certificates across a ten-year period. The findings show meaningful progress in some elements alongside persistent gaps in others.

The B-BBEE Commission recently released its review of South Africa’s transformation journey from 2013 to 2023.

The research analysed more than 28,000 B-BBEE certificates across a ten-year period.

Some of the findings are encouraging.

Enterprise and Supplier Development performance increased significantly over the period, while Skills Development also showed substantial improvement.

There are also areas where the data shows that businesses and sectors have more work to do, particularly around management control, gender representation and uneven sector performance.
