Are you a professional deputy, or advise family members who have been appointed as deputies?

Instructing an Independent Social Worker (ISW) can be a useful tool in your bid to ensure client best interests are considered. Especially in cases where family members are appointed as deputies and are paid for their role as carers.

In such cases, an ISW can assist in one of several ways. First, they can assess the cared for person's care and support needs. In order to determine appropriate renumeration for paid family members, it is important to establish the extent of the person's care and support needs. An ISW can also review the person's care each year to determine whether their needs have changed.

Some independent Social Workers have additional skills which can be utilized by professional and family deputies. They can assess mental capacity, opine whether the cared for person may be eligible for Continuing Healthcare (CHC) funding, or subject to a Deprivation of Liberty Order.

We have a team of experts ready to be instructed in EHCP appeals where the appeal is being extended to social care needs and provision. Since 2018, we have been instructed in children and young people's cases to accurately identify their social care needs and the provision required, whether that is care in their home or a residential educational provision. Our team of Senior Social Workers are skilled in identifying any social care needs which should be treated as a special educational provision. We can also be instructed in cases where young people are leaving the provision of an EHCP, and transitioning to adult social care.

The transition from Education, Health and Care (EHC) Plan provision to adult social care provision can be a worrying time for families, and we can help ease the worry by undertaking an adult social care assessment.

Young people are entitled to a free adult social care assessment from their local authority. However, it may not be undertaken soon enough, and may not consider the type of provision required, especially if the young person requires a specialist provision. Are you a solicitor, professional deputy or independent financial advisor in London?

Most of our mental capacity assessments are undertaken by senior Social Workers who are qualified Best Interests Assessors (BIA). The BIA academic qualification provides practitioners with a higher level of knowledge in all matters relating to the assessment of mental capacity assessments. This enables us to confidently undertake mental capacity assessments for solicitors, professional deputies and independent financial advisors.
